Dear Gov. Schwarzenegger:
As a fellow fiscal conservative and motorcyclist, I wanted to express my thoughts on an issue which has caused significant hardship on many dual-sport enthusiasts statewide. I’m referring to the ill-advised regulations promulgated by CARB in 2003 which forced the DMV to revise its long-standing policy of allowing “dual-registration” of D.O.T. compliant off-highway motorcycles.
Under the old rule, an owner of an off-highway motorcycle had the option of retrofitting his bike with on-road items such as turn signals, hi/lo beam headlight and other equipment required for an on-road license plate. This provision literally remained intact within the CVC for decades.
My request is simple: Rescind the rule barring dual registration of “Green Sticker-able” off-highway motorcycles. The justification can be summed-up as follows:
•Off-highway motorcycles sold in California already meet emission standards that are far more stringent than Federal on-highway emission standards.
•The contribution in pollutants from this category of motorcycle is less than .01% of California’s total emissions from motor vehicles.
•The vast majority of dual-sport and other off-highway riding takes place away from non-attainment areas; i.e., we ride in the deserts, the mountains, and other areas where ambient pollution levels are naturally very low.
•By not allowing registration of new, CARB-compliant off-highway motorcycles, owners of older, high-emitting 4-stroke (and even 2-stroke) models have no choice but to hold on to their older (plated) machines which are grandfathered under the current regulations. These older bikes often emit 10-20 times the pollutants of the newer products.
•Dual-registration is good business: This means more revenue for the DMV and state and local municipalities through vehicle license fees and sales taxes.
•Supports local economies. Riders of road-legal off-highway bikes can access small towns for fuel, food and lodging, helping rural areas develop & maintain their tourism business and increase their tax base.
•Procedures already exist at DMV and the CHP to perform dual-registration. No new costs would be incurred by state agencies to implement this change.
•This change in policy fills a void in the market. Factory dual-sport bikes are designed for 90% on-road use and 10% off-road use. Serious dual-sporters prefer a bike that is designed for 90% off-road use and 10% pavement use.
