If I'm riding down the freeway (on a motorcycle) with an unloaded rifle, open (bolt locks open when empty) action slung on my back, with ammo in the locked saddle bags, what would you do? Stop me at gunpoint? I'm curious.
What if I were sipping a white mocha at Starbucks with my SKS? :p

It is completely legal, if you are not a felon.
Any officer has the right to stop you to inspect the firearm to ensure it is unloaded. We have had this same issue locally, with guys coming back from hunting trips with long guns in their back window racks. It freaks out the Kerry voters, soccer moms that voted for Clinton and little old ladies that think Diane Feinstein should be President.
But, it's legal.. this is still America, even if it is Kalifornia!
Starbucks with an SKS on you shoulder? ..that's just asking for trouble! But, legal nonetheless.

I was afraid of getting slapped with a brandishing charge :confused It's a possibility..after all, I live in a college town and I doubt they'd fuck around with that. In any case, I have no use for going around town with my gun, I was just wondering if it was possible. I don't want to attract any more attention, I think the FBI is already watching me :laughing

Hmm so i can transport a 30 06 bolt action rifle on my motorcycle..? cool! I can carry the gun and bullets in the same area as long as its not loaded, that is the main issue correct? and im not a felon =)

how about a hard case to put the rifle in?
I think that would make you less interesting to the PoPo.
also the weapon would be protected if you went down.

Just so there is no confusion on the issue, ammo must be "separate" from the firearm. This means the ammo cannot be "attached" to the firearm in any fashion whatsoever. This means a sling that has loops for ammo cannot have any ammo in them if the sling is attached to the firearm. A technicality.. but an important distinction.

I'll be doing this exact thing on my way back from NY.
I need to transport my Winchester 32/20 lever action back to california, and will be on my bike.
So I'll be placing it in the case, and strapping it to my back (All my ammo is here, so I won't have any ammo with me).
I'll report on how interesting a ride it becomes.
Motorcyclist, wearing colors, carrying a rifle.
Anyone here I can call to bail me out?

I think you would be best with a soft bag, or even a guitar bag for transporting, especially since the wind makes things bang around at speed.

This is not required.
I think people are getting confused with airline transportation rules which may require locked and separate containers for guns and ammo.
As "motorman4life" said, just don't have the ammo loaded or even attached to the firearm.

It is an odd form of procrastination.
I've put off shipping it for five years....
Figure if I just grab it while I'm passing through, then it will get back to my place.
If I don't, I'll just forget about it again...
I won't need to strap it on my back for the ride back though, it will fit nicely against the side of the bike, resting on the passenger peg, poking up a bit over the tail and ending before the main footpegs (kind of like when I carried a bat strapped to the bike).
Then again, we'll see when I get there...if I remember, I must just have it shipped on the spot so it meets me back in california.
Assuming I remember ;)

Used to carry mah bolt-action on the bike (many years ago) with a red bandanna tied through the action where the bolt came out. Didn't have no case!
Never had a problem, but that was in the 70s-80s...
Valgar, I'll throw your bail if ya get popped. You use our equipment, gotta take care of the customers!

I used to take my shotgun to high school after going hunting in the morning too. Don't think that would work anymore either. :teeth

thats funny you say that because back home in Yoncalla Oregon we took our hunting rifles to class with us so we could go straigt huning after school, we stood our guns up in the back of class in the corner no questions no problmes but then agian my graduating class was a whole wapping 20 people:wow and the school closed on Opning day of deer season because most of us never showed up:laughing

On friday night I rode my bike with a cased rifle slung over my shoulder. it was uncomfortable, I wouldn't want to do it over 30 mph either.

I think the law states that the ammo must be "not in a readily accessible location" or some such. Basically that it's harder than reaching in the glove box for a clip (like the gun in the compartment and ammo in the trunk type thing). I know 2 people that were popped for a misdemeanor for having the pistol under the seat and the ammo in the glove box. Same compartment. Totally legal for ammo in the trunk and gun in the cab though. This makes sense to me as it would stop the road rage type situation and actually make you work to load the gun. Give you time to think.
As far as transporting for civilians the rules are only for moves. To and from the range or moving to or from storage. Taking the SKS (I have a nice 1952 Russian carbine) down to Starbucks would probably qualify under "brandishing" as you have no real excuse.
I'm no LEO but the above has kept my ass out of trouble for a long time and if it works don't fix it.

Do you know if the handgun was in a locked box under the seat? Law requires that handguns be in a locked box, no matter what type of vehicle you are transporting them in/on. In a car, the trunk counts as the locked box.
I'd bet that if the handgun was just sitting loose beneath the seat, that contributed largely to the misdemeanor charge.

I have been arressted simply because my container was not locked - it qualified as CONCEALED.
Don't forget to lock it, or else it's better off out in the open. I'll bet anything on that.

I rode a few miles in berkeley with a cased rifle strapped to my back. It felt pretty mad max, but I didn't have any problems...

sweet all i need is a big bag for my waders and decoys and i can take my CBR600 duckhunting! ive always wanted to do that. its a long way to the hunting site and would love the fule savings the bike would offer! just keep the Amo Away from the gun! CHECK!
