All-
I know there is something called a "permit to move" that all of us with handbuilt/GP bikes should have to protect ourselves, but here is my situation:
I have a '94 Honda RS125 that is worth enough money that I'd like to see it back in my posession ASAP so that I can sell it (it's a "B-kit bike") as money is tight right now in lieu of my boyfriend's and now my own motor vehicle accidents. And now I am also afraid that the person who offered to fix it has now stolen it and is possibly parting it out.
The plan was for a now "ex" friend/fellow BARFer to help fix it up so I could sell it at the beginning of the AFM race season this year to finance my season; he picked up the bike from my garage at the end of January '05.
I have been asking about the bike for 4 months now, and he refuses to return any calls and emails. The last time I spoke to him about the bike he said "what bike?".
What should I do? The only proof I have that I own it is pictures of me racing it. I also have emails and voicemails from him mentioning the bike.
Maybe he is using it as a "tie" to me, as he was quite disgruntled when I dumped him and got "stalky" on me. I dunno. I would think someone who races for a local shop in the AFM/AMA would have more class than this, but it appears to not be the case; most of my friends tell me to write the bike off, but I am hoping there is some recourse for this type of situation.

Was the bike registered to you through dmv in any way...if so, there is alot that can be done.

just call the police and show up at his door with them and some pics and the recordings...
make him prove he owns it. if nothing else it will get you a court date and he may just cough it up when the boys in blue are standing at his door.
YOu could file a small claims against him. but then the burden of proof is on you, and he could deny everything. Can you get a letter from the person you bought it from saying they sold it to you with a date? a bill of sale is enough proof of ownership (the pics of you on it help ALOT) for the cops.

i was just implying that you should simply ask one of the barf LEO's to help you out. obviously, the guy is just being a dick because you broke his heart, but would probably roll over the instant the law was involved. as well, if the guy is a barf'er, just shame him into giving it up. go on, what's his id ? or, how about you just go over there with your new boyfriend, RoundBoy. that ought to be scary enough to get results.
If it's an AFM'er then let the word get around. It's a small club and what comes around tends to go around. If anything it's satisfaction. At any rate any experienced 125er would pay maybe $1500 for a well sorted pre '95. That's about what I sold my '94 Works Sakurai kit bike for 3 years ago. Guess what I'm saying is it really worth the 3 race weekends of funds to deal with it? The racing community is pretty small and if you burn or get burned it gets around. Especially the small classes like the 125's. Your choice to take the legal route but it may be more satisfaction and less stress to just open your mouth and tell the truth to all the people he knows.

well he called. but didn't leave a message. so he saw this thread. i'm sure his moderator "buddy" pointed it out :rolleyes
but andy is right.
he knows he's wrong, he knows the bike isn't registered and he is probably acting out of spite. who does this in the racing community, and when they know that they are holding on to something useless to them and important to someone else who really needs all the help they can get right now. it's selfish and looks pathetic.
hopefully he is either collecting back up the parts to return a running machine right now, or he is hacking up what's left and tossing it in the bay!
and i dunno where you get the new boyfriend stuff :laughing
the "new boyfriend" is in bed with a broken neck, pelvis, hip and knee......
plus mr. stalker already came by a couple months ago late at night to get an eyeful......
and another thing that's odd, i know he lives in sunnyvale, been to his work dozens of times, dated him almost a year, but he never let me come over to where he lived.....

cykoklr- mr. ktm.... didn't have a wife/live-in; seems that way, but i can spot that kinda situation 10 miles away. plus he was at my place way too often and we have alot of mutual "friends".

that shit is all used up. trade it in on Roundboy. for a 12-pack, he'll do whatever you want. heck, he'd probably even have his way with your ex, just like in his avatar. that's proper payback for a bike thief anyway.

It was already mentioned.
If you know where he works, call the police in that city. Ask for a "civil standby." The officers will meet you outside his work. They will accompany you to go chat with this guy while you ask for your bike back. The cops will not take sides. They will only be there to keep the peace. However, most folks cave when they see the boys and girls in blue. Simply ask for your bike back. If he refuses, have the officers explain 503 PC. If he still refuses to give up the bike, file a claim in small claims court. All you have to do is prove 51% that he had the bike and refused to return it. Receipts or a statement from freinds or former owner is likely enough to prove your case. In most cases, people don't want the police at their workplace. That might be enough alone to get resolution to your situation.

I have a Sony digital micro recorder that I use for work dictation & school; its about the size of a small opened flip phone. Let me know if you'd like to borrow it.
I don't know about actual wire tapping but there is also the option of 3 way calling into your voicemail first so it is recording when you call the thief.

All parties to a recorded phone conversation must be advised of the recording in progress. This is why you hear "for quality and training purposes, this call may be recorded" when you call a customer service number.
that said, $15 at radio shack will get you a cute little dongle that plugs into your handset, and allows a direct tap for a recorder. none of this suction cup to the back of the handset BS anymore.
the digital recorders are great - usually the files are small enough to be emailed, which means getting a copy to an attorney (or saving it for record-keeping) is fairly simple.

no, my little bike is still among the missing. and now it probably has an effed up engine i had just rebuilt because he tried starting it like a lawnmower.

he said he got some redline oil and pump gas and mixed it 15:1

While on a "why do people $hit on me tear", i called Mi...., err, the guy who "has" my racebike and made him agree to a date with a witness......AUGUST 20th, to return a fully complete and running RS125 as he is leaving for dakar, and if i say 8/20 i may see it by 9/20.......
somehow i think i should bet my 929 that i won't have it by either of those dates!

Get the bike NOW and deal with the damages/money to get it back in proper running order thru small claims. If he's leaving for Dakar you ain't gonna see shiat.....
On second thought 503 PC - Embezzlement would certainly get his attention. Go talk to the local PD.

Your bike has been transferred to me and has been sitting in my garage for the last couple of weeks, ready for collection or delivery, whichever you prefer.
Just let me know when you would like it back.
