View Full Version : No Plate Fix-it Ticket Questions

I just had another run in with the 'no plate' issue over the weekend and I have questions.
The first ticket (in Fairfield) i got last year was strictly a fix it ticket for my plate not being mounted. I had it with me and showed it to him and explained that I just had a new hot bodies undertail put on and just hadnt put the plate on it yet.. so that was easily fixed! :)
Over the weekend me and 4 other gals up north (Elk Grove) were riding along and got pulled over by 4 cops.. yes 4! because I didnt have a plate (again) :cry A few months back, I had to lower my bike 2 inches so that I could at least touch the balls of my feet on the ground in regular riding boots.. (for those of you who know me.. I used to have to wear huge boots with 2 inch platforms in order to reach just a little) And I have not found a legal way to mount the plate... yet.. but I will be now!! If you have any suggestions for that.. that would be great too.
So here here are my questions:
My first fix it ticket was a Notice of Correction VC 5202. I fixed it, got it signed off and sent it in. This one is a Notice to Appear! At the top traffic is checked instead of non-traffic :confused The VC on this one is 5200 No Plates! I showed him my plate!!!:angel He also didnt even bother to run it.
Im wondering why i got a different ticket for the same thing? Why is this listed as traffic instead of a fix it ticket? What is the difference between the two codes (for the same violation) He said I would have to pay $10, where as my first fix it.. i had to pay nothing.. just have it fixed. Is this something that will go down as a point because of the kind of ticket he wrote it as?

If it says notice to appear you had best make an appearance on or before the due date and clear things up.
You might get a courtesy notice from the court with more info and a phone number. Call that number and inquire.
Things can get expensive and troublesome if you let this pass uncorrected.
Expect unwanted attention from the popo if you hit the road without a license plate.
1. VC 5200(b) is correct and, from what you said, should have been cited both times when your plate was not mounted/visible/attached.
Although similar, VC 5202 is generally used when a vehicle is displayiing a plate/placard/permit which is no longer valid/associated to that vehicle...like riding around with a vehicle's old license plate number, even though a new one has now been issued.
In both cases, putting on the assigned plate generally fixes the violation.
2. Was your 1st plate ticket issued by CHP on a white, heavy paper form? CHP officers have some versions of the fix-it ticket which require no fee. I'm unaware of any other law enforcement agency which has a "no-fee" fix-it ticket.
3. The citation, aka ticket, you received on a standard, "Notice to Appear", form, is what all the typical police agencies carry and are semi-multi-purpose. Because the box "Traffic" is checked merely indicates it's Vehicle Code-related and being sorted to the local Traffic Court. Checking the box by the officer usually helps other clerical processors of that ticket sort it from amongst "non-traffic" tickets.
4. While you'll certainly have the right to appear regarding that ticket, you shouldn't have to. You should later get a courtesy notice mailed to you (but don't just rely upon getting this notice if one isn't received in a month or so) which should explain how you can get that citation signed-off and where to mail it in with a $10 fee.
While there is no point for this violation, do get it corrected. Much more severe penalties exist and follow for failure to get it corrected and cleared in a timely manner. From your concern, I get the feeling you won't be letting this issue get put-aside or forgotten, though.
5. As for not running you or your plate, there are times when running this information via radio or computer become impossible due to technical difficulties. Other times, the officer may consider a person to be low-risk, i.e., not likely to be unlicensed/suspended/wanted/etc. and merely cite and move on.
Generally, I'll try to run everyone and every vehicle I stop, but even this varies by officer and agency, regardless of technical difficulties (like a message from the dispatcher of the LE computers being down).

Although they may sound obvious, here are some suggestions:
- The plate should be close to perpendicular with the ground so it's visible from the rear. Don't angle it up or down.
- Make sure it is lit and visible at night.
- It should be securely fastened so that it doesn't move around.
If you deliberately fail to correct a violation the officer can make future citation non- correctable and can even cite for more serious sections for willfully failing to fix it. See this thread.

You may be up for the $100 repeat offender smackdown!
They don't like it when they write people for the same mechanical violations more than once, so now they have the option to tack on a fine along with making you correct the issue. The window tinting craze back in the 90s was the real beginning to this tactic, but I've known some people who got hit with the $100.00 deal for things like no front plate and cracked windshields.

Alayna- I have some extra LED lite-bolts for plate illumination if you can figure out where to legally mount the plate.

I think the plate can be mounted where it is supposed to be with out it hitting the tires. I was playing around with it last night. When can I come over? :teeth

So they finally got you.....again!!! Just make a bracket,and angle the lower section back to give you a lil more tire clearance. Let me know if I can help. I can make one out of aluminum or carbon if you need. Nothing to fancy though, just a simple angle. I may do the same for mine just for the hell of it when I have some down time at work.

just cuz its kinda on topic, i'm gonna shair a funny story regarding a licence plate ticket i got...
well.... for starters let it be known that i've prolly received over 5 or 6 'licence plate not clearly visiable or present' ticket in my life. i think all but one of those have been issued to me while i was riding a motorcycle and in most instances i had a plate but the officer didnt like it for some reason. ANYWAY.... so the latest ticket for this type of thing was straight up because i had no plate on the bike. no plate because i had just installed my cool sexy hotbodies undertail and ran outta time to install the plate before i had to leave to see the girlie.... so one of my GREAT BUDDIES at the CHP (sarcasm) does me the glorious favor of pulling me over for going a totally reckless 80mph in a 65mph on a deserted freeway at midnight. he then proceeds to write me a fix it ticket for the plate not being present....
i install the stock plate and turn signals, get it signed off, go home and reinstall my cool sexy hotbodies undertail and this time the plate with it :thumbup turns out the fine for speeding was $114, and the licence citation fix it was $10. making a total of $124 owed to our lovely state.... i fight the speeding ticket, officer doesnt show and ticket is dismissed, and $124 is reembursed to me
