View Full Version : can some one please explain this? - notice of correction and proof of service.

forum newbie here. long time reader first time poster.
hahah i sound like a radio listener. anyways...
first i'd like to state that this website is great and i find it very useful.

so here i my question... so i go up to SF for a friends wedding over the past weekend. passed the SFO airport on the 101 heading south. minding my business and am i nthe #1 lane going with the flow of traffic.

next thing i know a kind CHP officer pulls me over.. apparently for speeding.

i didn't do anything wrong but merely go with traffic and was unlucky to be picked out of like 6 cars completely surrounding me.
anyways, so i pull over and he comes over to the car and asks me why he was pulling me over. i say " i don't know." officer says he pulls me over for speeding. tries to get me to admit i was going 80 mph. but i don't admit to anything.

so instead of arguing and possibly escalating the situation, i sign my ticket ( since i hadn't gotten a ticket in like 3-4 years) and be on my merry way.
so he cites me for speeding. he wrote apprx 75+ on the ticket.

fast forward to today...
i get a notice in the mail. i for sure thought it would be courtesy notice stating my bail and options, but nope... it is a "notice of correction and proof of service." it has my name, amending officer, highway patrol area and citation number.


i read line #2." the citation issued to you contained an error as indicated by the items check below. This notice of correction does not affect the validity of the citation or the required court appearance."

and below, the "other" box is checked and under it is written "max speed:65"

now what does this mean? i am assuming i'm probably going to get another mail showing the bail amount and my options, but wanted to know what this notice means.

any info would help.

Look at the "Max Speed" noted on your cite... he likely put 55 or 60. The correction was to legally amend your ticket, that's all.

If a police officer makes a mistake while writing the citation, and doesn't realize it until after he's given you your yellow copy, he has to go through the amendment process.

The Chippy made a mistake regarding the maximum speed for the highway, on your cite. Since he couldn't just scratch out the original, he had to do a citation amendment. That's it and that's all.

yeah, i noticed on the cit that he didn't put a max speed on there.
okay. so basically he wrote the notice of correction because he forgot to write in the max speed on the cit.

def gonna do the TBD. how much can i push back the court date??
can i push back the date as long as i can then do a TBD???
