View Full Version : do i need to report a minor accident?

well it finally happened. i was lanesharing on 92 eastbound and a car pulled out right in front of me. i almost completely stopped, but i had just a little too much momentum and i barely hit the car. i did not sustain any injury (thank you elbow armor) and just broke the rear turn signal and scratched some fairings. so we exchanged info and i told him that if he paid for new parts that i would repair myself and not report it to the dmv or insurance. so my question is this: do i need to report to the dmv being that it was a non injury/minor accident with around $500 worth of damage?

If there is no injury and total (both vehicles) damage under $750, there is no requirement to file any report (police or DMV).

You might want to keep it out of the insurance, since by your description you hit him. You most likely would be considered "at fault"

Good to hear you weren't hurt.

It is hard to tell form the description, but if the other vehicle made an unsafe lane change or moved left or right without ensuring it was safe to do so BEFORE making the move, then he likely is NOT at fault. Of course, once the lawyers get involved, it is anyone's guess... shit, he may end up being held responsible for the Lindberg Baby kidnapping!

If the other driver has agreed to pay for the repairs, then obviously they realized they made an error and are probably lucky the motorcyclist was not hurt in the process.

well, the driver admitted fault to me right away, as he changed lanes cutting me off and causing the accident. by the way, while i was lanesharing prior to the accident, at that moment i was the only one occupying that lane, until he decided that he would like to occupy that lane. i have not been able to get ahold of him, but i did get a call from his insurance company and they "are willing to accept liability" so i am now just waiting to hear from the adjuster.
