View Full Version : Caught w/no helmet.. then what

Was riding down mainstreet in pleasanton last month, and saw a guy approach an intersection from my left. Noticed he didnt have a helmet. Iam thinking "dude wtf major attention whore" So just after he makes the turn, a leo stops him right in the middle of the street. Do they make you tow the bike? I cant imagine he got a ticket and let him go onward.

It can go 3 ways. Have him park it, I tow it or he calls someone to bring him a helmet ASAP. He is not riding away on it w/o a helmet. If it is parked, I likely would take the key and have them come in w/ a helmet and ID to get the keys at the PD.

ok... well thats why I always lock my lid because if someone lifts it, iam not goin anywheres

It was at Pashnit end of season BBQ, Calveras Big Trees State park. A rider moved a bike from one parking lot to an adjacent parking lot. Left his helmet on the picnic table. State Park Ranger code 3'ed and ticketed him.
Laguna Seca Moto GP weekend. Cannery Row a rider on miss America replica cruiser. After riding near full length of the strip with theHelmet stuck on the sissy bar. Road past five Monterey moto LEO parked on side of road. Stopped him and gestured to put helmet on.
Runs the gamet if you have the helmet available what'll happen.

22651(b), (d), (h), (o) or (p) CVC, whichever is most applicable. It is rare for me to tow a bike, unless they are unlicensed or arrested at the scene. In most cases, if they do fail the attitude test, one of these sections is bound to apply.

I recently had a guy park it and then another officer caught him continuing to ride w/o a helmet a short while later. I had them cite him for 24004 CVC and I towed his bike for 22651(d) CVC. Now I just take the keys and have them pick them up at the PD.

Also, rather than citing for the standard (no-points) equipment violation, you can write the no-helmet ticket as a (1-point) moving violation under 24002(a) CVC on the first offense.

u can count on at least $150 for the initial tow, plus at least $60 per day of storage...

If the engine is off, is it ok to move the bike around the parking lot, pushing with my feet with no helmet?

Pushing (not operating, pushing) a m/c, MDC or motorized bicycle (moped) on city streets or operating in a parking lot w/o a helmet are okay per 27803(d) CVC. Local ordinances may be different. Operation of those tyles of cycles on city streets, freeways and state routes without a helmet would be illegal as per 27803(b) CVC for operator and (c) for passenger.

8 years ago when I started riding my F2. Yeah..:laughing That was me on the side of 101 between Morgan Hill and San Jose....in June (when it started getting hot)...ran outta gas. First and LAST time THAT will ever happen. Here I am..pushing my bike along the side of 101. Nice random guy in a BMW comes and picks me up...I park my bike..and he takes me to go get gas...and drives me the WHOLE loop back to get my bike and fill it up. Asked for his business card...sent him a thank you card and took him out to dinner. Man! :thumbup for him.

I had to push my bike about a mile back home one time, uphill, and it would have been FAR too hot with a helmet on. Even as it was, wearing a t shirt, pants, and boots the shirt was soaked by the end. I can't imagine how bad it would be with a helmet on.
