A buddy of mine tried out my bike without a helmet in the alley way behind some appartments. Unfortunatly a CHP saw him and gave him a ticket. I thought it was private property. Does anyone know if this is legal. thanks

I received a no helmet ticket while on our private road that had a closed gate, took it to court and it was dismissed no questions. Mr LEO had to answer why he deemed it nescesary to open a private property gate cross over a cattle guard and write me a ticket while riding a dirt bike. though if it was a alley as you say it was probobly a city owned street.:confused

Check with the city/county and find out if it's a public road. If it IS private property fight it.

+1. If it is maintained by the governent for vehicular travel, it is considered a highway by the law. If it is not, then the ticket is 100% beatable.
thanks gentlemen haha, that friend was me...was kind of stupid, but was only for literally 30 seconds to check my friends new gsxr out...
Will check with the county, see what the situation is...

Anyways thats not his jurisdiction unless that city is unincorporated
