View Full Version : Passing Vehicles That Move Over

There has been several vehicles I've come up behind lately that have moved their right side tires on to the shoulder. Some of these drivers are now looking at me in their rear view mirror instead of looking at the bicyclists on the shoulder up ahead- but that's another thread. It just seems like a dangerous set of circumstances. Now just because they pull right doesn't mean it's safe to pass, especially in the twisties. When a driver does this on a double yellow, can I zip past without crossing the DY and also without getting a ticket? Just how does the interpretation of lane sharing apply here?

It will be interesting to see what you get. Some friends got popped for doing this last summer - essentially lanesharing with a cooperative cager where there was a DY. The LEO wasn't interested in that explanation.

Bill, I don't know if Gary fought them or not. I'll have to ask him. I don't remember who else got ticketed. Of course my DY that day was pretty flagrant... :shhh

C'mon AR7 tell us how you really feel about the bicyclists. :twofinger
I think it still qualifies as illegal unless they pull off the road and stop, but I'd probably go for it, and fight the ticket if one was issued.

I'll sometimes be driving slower than other people want to, and therefore use a turnout when I get to one. I generally don't even stop fully, I hope that isn't opening them up for a ticket.

I've learned that on long 2 lane roads that see a decent amount of traffic (say, CA46) it feels MUCH safer to flow with traffic at 65 (limit 55) than to try to do 55 and constantly have people passing you. passing on 2 lane roads with traffic is frequently done very dangerously (I've had to brake/swerve to avoid headon collisions a couple times, when I was in my lane, because people thought they had more room than they did)
