I was at my desk doing some paperwork when I noticed a car pull up outside in the shop parking lot. I'm thinking :wtf is he here for on a Sunday????? He then parked right next to my race trailer and I knew what was up right away. So I grabbed my camera and ran outside like a rabid dog. I screamed extremely loudly at him as I approached.

"YOU ARE SO FUCKING BUSTED ASSHOLE!!!!!" And I was taking pictures the whole time. He threw his bolt cutters back into his car and got in, revving the shit out of his motor. He was saying "NO!" over and over again. He pointed the car towards me so I had to back off.

Then he sped off.

Petaluma PD has alerted CHP and are running his plates as I write this. The seargent was pleased that I got pictures, including a face shot.

Maybe this fucking scumbag will do some time. Fucking lowlife piece of shit. :finger

The trailer is empty with a wheel removed so it's harder to steal. He was trying to get inside.

So I have temporarily taken them down.

That would be something- this fuckstick sues me because I posted pictures of him committing a crime and calling him a thief.

I will post the pictures back up after I get approval from the authorities.

This whole thing happened at 6:15pm tonight. In broad daylight even!!!!!!! He was just about to cut the lock with some big bolt cutters. There are marks on the lock. I was pretty aggressive when I screamed at him. I definitely scared the shit out of him. One of my friends told me I could have been shot had he been carrying a gun. The funny thing was I felt absolutely zero fear about confronting him. Adrenaline is funny stuff.

Update:

I just got a call from the Petaluma PD.

The Sonoma County Sheriffs just arrested the guy. He had apparently been a one man crime wave in town here today, thinking because it's Easter nobody would be around. There were several incidents that they think he was responsible for. The detective said he was driving up there now to match the pictures I took to the perp. He was apparently on parole also.

Score one for the little guy.

There is no "duty to retreat" by a private person in CA that I'm aware of...

But I don't recommend people shooting each other even if it's justified unless it is an absolute last resort to protect one's life.

Photo's taken in public places have always been considered ok.

You just need to be careful and use words like "alledged" "might have been", "appeared to be", prior to any statements.

No. I just know how the justice system works. If you are lucky the guy will be picked up with the cutters in his car. If the guy is halfway smart he will "store" the cutters in his neighbor's garage. If you are lucky he will have a rap sheet. If not it is a coin toss. I hope he gets convicted but even with these pics, it is his word against Alan's and since you brought up rape cases, let alone property crimes, I know from experience it can be a crap shoot.

yes if the cutters were found in his possession, with his rap sheet and Alan's testimony, he is toast. More than adequate to find him guilty beyond a reasonable doubt (although this will never go to trial).

If the cutters were not found on him, the case will be extremely weak (unless they found and linked other property in his possession to other victims). Some thieves are pretty stupid and since he is on parole, they might be able to lean on him pretty hard and get a plea bargain.

If you really wanted to nail him, you should have called the cops and let him continue on unmolested. If they catch him standing in front of your trailer with half your shit in his car, it is open and shut.

Of course then you take the chance that the cops will drag ass, and he will walk off with all your shit before they can pick him up. its a crap shoot as always.

I really wanted to nail him, so I acted. I wasn't going to wait for the cavalry to show. He would have been LONG gone by then. My mistake was not dialing 911 as I left my desk to go outside. Had I done that, the dispatcher would have gotten a call with no one there to answer questions- which I would hope they would place some sort of increased priority on. But even then, there were very few officers on duty on Easter Sunday at dinner time. Which is probably what this alleged fuckstick was counting on in the first place. Remember, there were multiple vehicles broken into that afternoon all around town.

But this whole thing was done in 20 seconds. The cops took about 20 minutes to show up....... and I called immediately while the guy was still peeling out of the parking lot.

As the guy was on parole he is fucked. If it were his first offense he might walk, unless there is some overwhelming evidence he would get the universal treatment:"If you cop to a lesser offense, you will walk out of jail today." That's how our system works. The only guys who get reamed are the habitual offenders.

The reason not to post pics is not just the prosecution, it is to avoid a civil lawsuit if the guy slips through the cracks. Though in this case it sounds like his crak is going to get slipped through.

It depends how badly the DA wants to go after this guy. In addition to burglary, he could also be charged with reckless driving, vandalism and loitering. It just depends on how much motivation the DA has.

I don't see this case going to trial. The perp will submit to some sort of plea deal.

I don't think he needs to bother with the alleged or "innocent until proven guilty" disclaimers. In order to be sued for libel (printing damaging false statements about other people), senor douchebag would have to prove that Alan knew his statements were false or acted with a reckless disregard for the truth. Given the photo evidence, that's highly unlikely. But of course, the CYA approach never hurts.

As for the tainted ID thing, that's a good point.

(resident shoots at car burglars)

District Attorney Jan Scully today announced filing decisions in the cases of Sou Saechin, Marco Virelas, and Larry Tran. Sou Saechin was the resident on Rock Creek Way who, on April 4, between 2:00 and 3:00 a.m., confronted three males breaking into his vehicle, which was parked in front of his house. The three males were Virelas, Tran and a juvenile, 17 year-old J.C. Saechin fired one shot from a .22 rifle which struck J.C. The three males got into their own car and fled. Saechin fired approximately three shots at the car as it drove off, all of which missed. Tran and Virelas took J.C. to a hospital.

The case against Sou Saechin is analyzed in two parts – (1) firing the first shot which struck J.C. while the burglary was in progress; and (2) firing the shots at the fleeing car.

A person may not use deadly force to defend property, but may use deadly force when he reasonably believes that another person presents an imminent danger of death or great bodily injury, so that the person acts to defend himself. Saechin heard noise outside and went out to deal with burglars breaking into his car. He found himself confronting three males, two already inside his car and one (J.C.) standing outside it. J.C., with his hands in his sweatshirt, appeared to step towards Saechin. Fearing J.C. had a weapon and that he was about to be attacked, Saechin fired one shot, hitting J.C. in the upper torso. Under the circumstances, we do not believe a jury would find Saechin acted unlawfully in firing this first shot in self defense.

Once the three individuals were fleeing, Saechin fired three more shots. Saechin said he was not attempting to shoot any person, but was simply trying to leave a mark on their car so the police could later identify it. Since he was no longer faced with imminent danger to himself, this shooting is a violation of Penal Code 246.3, discharge of a firearm in a grossly negligent manner. These three shots did not strike the car or any person.

Tran, Virelas and J.C. were engaged in burglary and attempted grand theft. They broke into the car in a sophisticated manner, and were attempting to steal the air bags. In addition, Tran and Virelas both have criminal records. Tran is currently on felony probation for unlawfully carrying a loaded firearm, and misdemeanor probation for giving false information to a peace officer. Virelas is on misdemeanor probation for unlawfully possessing an assault weapon. Both have additional criminal records.

The only witnesses who saw what happened during the early morning of April 4 were Saechin, Tran, Virelas, and the juvenile J.C. Saechin is a necessary witness against the burglars, while they are necessary witnesses against Saechin. For this reason, it is not legally practical to prosecute both cases. Under the circumstances, since no one was injured by the unlawful shots he fired as the car drove away, the District Attorney has elected not to prosecute Mr. Saechin, who has no record and whose testimony will be needed to prosecute the burglars. The District Attorney will prosecute Marco Virelas and Larry Tran for the new offenses, as well as for probation violations.

The District Attorney emphasizes that deadly force is only permitted when necessary to protect oneself or others from death or great bodily injury. The indiscriminate use of firearms is not only unlawful, but presents a danger to innocent bystanders and neighbors. Persons who use deadly force to protect property do so at their own peril. Our decision not to prosecute the person who fired shots is based on these specific facts. Here, the balance weighs in favor of prosecuting the burglars and not Mr. Saechin.

Since J.C. is a juvenile, we will make no public statement about any prosecution he may face.

Of course every now and then we miss and the 9mm goes flying across the street and kills a ten year old, but that should be allowed under self defense. Last year my car was stolen from my driveway. Nine days later my husband saw three guys in it not far from my house. He could not catch them so I grabbed his car and went searching. It took me 45 minutes at speeds up to 90mph but I caught up to them. The driver is currently in juvenile hall.

I wrote a letter to te DA saying that I went out of my way (like you did) to catch the criminals and I expected a prosecution to the fullest extent of the law. I told him that I would be at every court date. I told him I was ready to identify and testify against him.

When they knew I was serious, they were more serious. THe DA later told me that without my testimony they would not had got that harsh sentence.

Contact the DA and let them know that you can identify him and that you will be at every court date.
