I 21655.5(b) Failure to obey sign posted preferential traffic lane(s); exceptions – motorcycles, mass transit buses, and paratransit vehicles.

Given to me a few weeks ago by Highway Patrol in San Jose on 101, between Oakland Road and 87. I was in a car by myself in the carpool lane at the wrong time.

I've been doing some research and can't seem to find a clear answer. Will this ticket be a point on my record if I do not go to driving school? Do you happen to know if this is the sort of ticket that will increase my insurance, if said point goes on my record?

Thanks everyone.

Christie

This is a DMV listing (by code #) of the violations that are assigned "negligent operator" points. If it is not a point, you would not want/need to attend traffic school. As for what YOUR insurance co. will do to your rates, in light of this violation, as with any violation, that is between you and them. If they find out about it, they may well jack your rates. I'm sure there are some companies that do and some that don't.

It appears 21655 is not on the list. I don't think seatbelts are either, but child carseats are. Go figure!
