cvc 125000 even though the LEO wrote down the DL# on the citation?

A co-worker from visiting from China got a speeding ticket (80mph on 680 near great mall) and also got a cvc 12500 (unlicensed driver). However, the LEO put the China DL# on the citation. Exactly what does this mean? The LEO did ask him for the Hertz rental agreement, but he did not have it on him. However, this isn't a cvc 12500 right? I'm taking him to the nearby DMV tomorrow to get it fixed, just wondering why he was cited.

Maybe no International Driver's License??

Could be complicated stuff. I'll be curious to see an expert opinion on this one as well - we deal with Mexico DL's all the time.

I dont think that 12500 (A) VC applies.

How long has the guy from China been here? Is he living here? Has he established perm residence?

If he's here for work, and is not a perm resident, then 12500, IMO, doesn't apply.
 
Look up 12502 VC for exceptions to the requirement to have a valid license whle driving.

Look up 12505 VC for residency rules. If he doesn't qualify as a resident then 12500(a) does not apply.

non-resident, here for only a month or so. About a year ago another co-worker got a speeding ticket on the way to Vegas and the CHP LEO accepted the China DL. We'll see what happens at the DMV tomorrow :). Or should we go to the CHP office in San Jose? He got the ticket over the weekend and returns to China soon, so we can't wait until we get the notice in the mail or until the citation is in the system.

He might have been cited before in California, thus, issued an index number which might have been what the cop wrote on the ticket in the DL# block of the citation. But if he isn't a resident . . . . he may be able to fight that one . . .

Update for anyone interested:

- The DMV only processes citations that involve a California DL.
- We went to the San Jose CHP station and got the 12500 signed off :). It took about 10-15 min for the officer to ask a few other people since this wasn't a typical scenario.
