So, about a month ago I got a speeding ticket (on a motard, on the freeway?!?). I kind of forgot about it and just now found it in a pile of paper on my desk. Since i haven't received a courtesy notice, I decided to look at the date on my cite.

Uh oh. Does that really say "WHEN: w / in / 10 DATE: DAYS "? Can they do that? I didn't think the courts could get their act together that fast. I was hoping to do this all by mail, 'cause it's gonna SUCK to have to drive down to Fremont for a 9 AM court appearance. :(

I guess I should just get my ass to court ASAP, huh?

Also, I noticed that the citing officer is Rasmussen but the arresting officer is Coker. What does that mean? And the "Date" is not filled in. Should I fight it?

1. section you were cited for 22349(A)
2. city where you were cited Fremont
3. your vehicle info (not required, but helps alot) 2000 KTM Duke II
4. what the OFFICER TOLD YOU I clocked you at 88 but I'm writing you for 80. edit: in a 65 zone
5. what you TOLD THE OFFICER Thanks. I think I'll take traffic school. :teeth
6. a brief description of the location (ie...lights, what type of intersection, what type of street, etc.....) Hwy 680 SB N/of Durham

How fast were you going?

You didn't mention the speed limit, but I imagine it was under 80 mph. :laughing

If I were speeding, I'd take the ticket into the court ASAP and tell them you could not read the ticket, did not receive a courtesy notice and want to take care of it ASAP. See if they have an initial fine amount and if you are eligible for traffic school. Take it from there depending upon the answers you get.

If your speed was more than 25 over the posted limit or safe speed listed, I would likely schedule an arraignment and plead to a lesser speed (70, 75). If the judge will take the plea, then it may reduce your fine some and keep you legal for school.

Keep us posted.

You can go online in some areas and get an extension that way, or call them. You don't have to go down there.

Yes, they can do that. What it means is that the top name is in the officer who issued the citation and the bottom name is the officer who measured your speed by what ever means. ie... airplane, radar, lidar, pacing. If you go to court, both officers would need to show up.

Since the date/time is on the top of the citation, it does not really matter if it is at the bottom or not. Now, if the incident happened on one date and the citation was issued on another date (think complaint filed) then it should be filled out to show the difference.

Not sure. I thought I was going about 80 and I had just accelerated to get clear of a pack of hungry SUVs. I could have been going 88. :dunno

I was only thinking about fighting it because of the two officers thing and the blank date.

Thanks. I'd actually rather just pay the ticket and go to internet traffic school than deal with fighting it and actually having to go to Fremont, but if I have to go to Fremont, I might as well fight it. I think I'll call first. It's about a 35 mile drive.

Thanks. That's why I was considering contesting the citation. I didn't realize until today that it was one of those tickets. But I was asking about the

WHEN: w / in / 10 . . . DATE: DAYS

part.

" Citation not on file, it can take up to 6 weeks to enter citation into system.
Please check back." :laughing

:| Up to six weeks?!?

I guess I'm misreading my ticket...? I can't figure out what that says... Maybe it's "w / in / 90"... :dunno

I have never heard of one being within 10 days. That would be extremely fast. Normally 30, 45 or 60 days is the norm, but it could be 90 days. I cannot read it either. Call the CHP and ask the front desk officer.

I believe Fremont court has 60 days, and that is what it looks like to me on the ticket. The officers were probably working a speed team with Lidar.

Just a note of caution: for one of my previous citations, the ticket didn't show up for six or seven weeks. However on the cite you receive I believe it usually states that not receiving the courtesy notice is not a valid excuse for not appearing in court or paying the fine by whatever specified date. So you might want to check into it, as sometimes booking a court date can take a little bit. I had my date booked for several weeks, and the courtesy notice didn't show up until about two days before my court date. :| Hope it works out well for you.
