So im at starbucks in san jose...capital xpressway...and these 2 under cover cops come to me and tell me to take my helmet off...then they ask me what bike is mines out of all the ones parked there...i show them the CBR wih the Key in my hand and turn it on...they still insist i fit the description of a black male riding on a GSX-R...he even mentions not to many black dudes ride around on rice rockets in san jose (by the way im obviously black). So these 2 cops question me ask for all my numbers in my received calls list and take all my info and my ID card...What sucks is the fucked up by not letting me go...since i wasnt on a GIXXER i should have been let go...But cops bein ass holes they are said to me...you must know this guy hes black and your black...is he a buddy of yours...im thinking WTF! Cause im black i should know this black GUY! that was fucked up i don't care who you are...i just want to know what you guys think about that??

And y did they threatin me about takin me in? WTF where is the Justice there

You're entitled to ask them for proof they're law enforcment officers before dealing with any questioning. A uniformed officer has to have their name or ID per PC 830.10. I'm actually not sure if there are specific language on the books for undercover officers, but you have every right to ask them for ID.

If they are actively investigating a crime, I believe you have to cooperate on some level, but you can easily counter that with 'are we done? am i free to leave?' and 'am i being detained, and why?' That will make it clear that you won't be walked on.

The asking for your cell phone recent calls is something you can absolutely say no.

If you obtained their IDs you can relay your concerns/complaints to the appropriate channels.

The reason why they were giving you a hard time is obvious, you fit the description of someone they were trying to track down. Now the way the questioning was handled is an entirely different story.

They said they were looking for a guy on a GSXR so contrary to what you said, he did not fit their description, and even after he showed them his bike they still hassled him. Total BS!

It kinda sucks but the ONE time I was in my car with my ONE black friend the cop came up to us and asked him to get out of the car and searched him. She was a bitch and in the end said someone from the gym called and said a black guy had a gun. There were no black people in that gym for the last two hours.
I wrote a post about it a few years back, funny stuff. She basically searched the first black guy she could find. I think Pacifica PD had a contest on who could search a black first after that phone call.

Sucks you didnt grow up a white Jew in a gated community. I dont have a worry in the world.:p

Cops are not bad. The ones you came across were definately in the wrong and not professional and I'm sorry to hear what you had to endure. There is no excuse for it.

But don't let these two ruin your image of all cops. Most cops are good people. Most cops are not ignorant like that.

In a diverse place like San Jose, this is really surprising.

Figured I didn't have to mention this in my first post but it's obvious I have to...if you DID NOT ride a moto, would you really know the difference between a CBR, GSXR, Z6, R6, etc? Much less give a crap? According to your story you claim the officers were trying to track down a black male on a GSXR moto. You are a black male on a CBR. Initial reports can be wrong at times, not every witness is keen on their moto knowledge as well. Keep in mind that I don't agree with the questioning portion, but as far as being confronted in the first place...

I was at the SF CHP office a few months ago and started up a conversation with a Harley rider, we were both bitching about getting pulled over for random shit...DOT lights, suspicion for various things, do we fit a certain profile (me white, he black), were we the guy who some guy saw who broke a mirror on some guy who was in car.... He said he spent most of his time in Oakland and cops always pull him over for his loud HD pipes. I looked at him and smiled and simply said, "Dude, they pull your ass over because your black." He smiled back and said, "You said it right there."

That is my story and my two cents. Profiling riders is pretty shitty in the first place, but the color thing is whole different degree. All it takes is that 1% of the LEO's to make us all very very jaded.

yep, (all) cops are bad because someone was checked out at starbucks on capital, riding a sportbike, and didn't like it.

from everything I've heard about that area, they should be stopping and checking everyone on a sportbike.

Keep an eye on your bike. They just might be thieves. Lots of crimes being committed in the bay area by folks pretending to be something they aint.

I would call SJPD with the location and approx time of the incendent. If they were real cops the dispatcher should have a record of reporting the suspects to any cops in the area. Explain to them that you have a legit feeling that they might have been thieves. Dunno if they'll cooperate, but it's worth a shot.

I got stopped once for matching the description of someone the cops were looking for. The officer was polite and didn't hassle me in any way. He even showed me the picture of the suspect. The resemblance of myself and the suspect was uncanny, so the officer was just doing his job. Sorry you had such a bad experience, but remember the bad cops are the exception not the rule.

Simply ask the officers, "Am I free to leave?" If they say no, then they have to have enough articulable factors that lead them to have reasonable suspiscion you have been, are about to be, or are currently involved in a crime. If they do, then they can detain you as long as reasonably necessary to confirm or deny the articulable factors.

Reasonable suspision can be based on; Observation,Training,Experience,Witnesses,Victims, Appearance of the suspect,
Actions of the suspect, Driving behaviors, Criminal history of the suspect, Demeanor
Time of day and day of week, etc.

Its all about the Totality of the Circumstances. What did the officers know at the time of the stop that made them believe the person they stopped was or was about to be involve din a crime.

Yeah but did the person that called it in know the difference? For people that don't know sportbikes everything is a GSX-R because its one of the more well known bikes. Just like people call a personal watercraft Seedoos or jetski.
*Not saying what the officers did was reasonable or ok just stating that Descriptions aren't always accurate especially for brand names.

Ok maybe there is truth about they don’t know bikes. But now that the new motorcycle enforcement team is out there, it's getting stupid. There are 2 guys in it that have been harassing people and doing the same crap he mentioned, I saw them messing with 2 guys off Monterey RD just last week. Then We had one of our Guys get messed with by the same 2 guys but he took care of it real fast ask the questions of the officers, then gave them a business card to our lawyer and walked away. While we laughed then left but not before getting a nice 5 photos and badge numbers names and even the Lic number off there car. Seems they are going to try a pull some shady crap they should do it on the level and all. Bye the way yes our guy was black and the other 2 we saw earlier in the week were black to.

Oh I see now, it was your conscious choice to give the officer your confidential personal information. You were aware he was invading your privacy (and that of your friends and associates), you knew you could be incriminating yourself, and you made the choice to forfeit your rights. And then you came and bitched about it on teh intrawebs. It all makes sense now.

Some cops, yes, are badge heavy. It happens, but not all LEO's are that way. As for TeamJordons suspension, and him not doing anything wrong, I'd suggest reading the TOS. Wacki laid it out pretty clearly.

Hey man, I understand how frustrating it can be. Yes, there are some cops out there that used to get beat up by their sister and now it's their turn to have some power. But PLEASE believe me - that's a huge minority of them.

I've met a lot of cops, have friends on the force, and the overwhelming majority of them are good folks with good intent. Don't let the few ruin the name for all.

And tell him it's all good. He got carried away with his emotions. Perhaps if the person that baited him got suspended first, he would not have felt the need to retort in a similar, uncivil fashion.

It takes a while to adjust to things on BARF, but you gotta have dicipline over your emotions, or else we're just as guilty as any "bad cop".

I would encourage you guys to follow up with SJPD and get to the bottom of this. Doing so you may help protect the rest of us from what could potentially be some folks impersonating cops, or at the very least hint at improvement for standards of professionalism.

A great ending to a sad thread.

To the OP: What you described, as you described it, should not have happened. I have worked undercover and in uniform for over 20 years and so long as the person I was dealing with kept their cool, I have always been cool with them.. everyone from jaywalkers to child molesters, from seatbelt violators to cop killers.

As suggested previously, you should follow-up on this and file a complaint if you feel your treatment was outside the stated goals of the agency they represented or if you feel your rights were violated.

I have a sneaking suspicion these were not actually cops and you likely got punked. If that is (or is not) the case, you could verify that and possibly file a report for impersonating a police officer (146 PC) and/or unlawful detention under 146 PC .
