View Full Version : CHP gave me a blank ticket

I was traveling Southbound Hwy 80, pulled over into the scales in Cordelia (I have no idea where he was hiding). Pulled me over for "going over a hundred" (I was), and "passing on the shoulder" (I wasn't). The motor-cop was nice and gave me a ticket for going 90. I signed, took the ticket and told him it was blank (there is absolutely no indication of writings on my carbon copy). He replied, "Oh, I was using a gel pen. You will get the citation in the mail in a couple weeks. If you don't, call the courts."

Should I fight it, or take it like a man?

You should have told him to "press hard, four copies" when he filled out the citation. :laughing

From what Ive heard if you fight it or bring it to court they usually reduce it down to half of the original penalty you were delt with. Dosent hurt to try! Good luck!

Hey, you could have some fun with this. Write out a ticket for doing 175mph, and leave it in a friends glovebox. :)

riiiiight.... i say use it to give the judge a citation- best bet on getting off the hook.

Despite the fact that would be a felony, I would hazard to guess the court *might* check with the officer's submitted copy. Just a guess.

Oh, and actual ink on a carbon copy is always a clue.

Personally, I think the officer should be using a standard ballpoint pen. It's not really fair to give you a citation you can't read. Maybe gel pens are cool, I dunno. Use them to write reports. If you're issuing citations, though, you should be using a ballpoint pen. We don't all have the best handwriting, and legibility is subjective...but if I were his supervisor I would probably discuss it with him.

Ha been there done that. My business was having a run-in with a stupid landlord, which resulted in us witholding rent. The landlord faxed us an eviction notice - so we faxed a cheque for payment. :rofl

Had something similar happen to me. I went to the CHP office and explained to them what happened. They found a photocopy of the original ticket. Gave me a copy and then the LEO even had a hard time reading the original ticket. So I showed up to court, all dressed up and smelling my best and the CHPer who pulled me over and who had wrote the ticket never filled out the paper work and I walked out none the worse. Good luck.

if i were a LEO and filled out a ticket with a gel pen.... and later someone fought it in court... i think i'd be too embarrissed to show up

for dismisal. You can argue that since the officer did not provide you with a legible copy of the citation, you could not prepare a defense since you could not tell from your copy what violations you were being charged with. You show the judge your copy, tell him/her what the officer told you at the scene, that he'd used a gel pen and that it didn't matter that your copy was blank. IF the officer is present, the judge may give him a talking to and then dismiss your case. IF the officer is not present, case dismissed.
