View Full Version : Second Ticket in less than a year, Traffic School?

OK so my good judgement completely failed me and I was speeding(a gorgeously warm day and a fresly finished bike didnt help), i F*cked up. I undersand. Now heres my Question.
I got a ticket mid last summer (speeding again, cought doing 80 in a stretch of empty CA505 wich is a 70 zone, im still annoyed about that one :mad) and dealt with it accordingly: paid the fine, went to TS, still have a clean lic. etc. Now i get slapped with this ticket writen as 80 in a 65 (tho the cop was fairly forgiving, its actaully a 55 zone, and he didnt want me to get TOTALLY fuxored seeing my clean record etc.) Then a co-worker said to me theres a law that allows you to do trafic school if the tickets were less than the normal 18 months apart, i was a little :wtf but my interest spiked, i really have an interest in keeping my clean record, my good driver discount is really nice. so whats the deal? anyone in the know care to clue me in? is my co worker full of Sh*t?( a very reasonable possibility to be honest)
If it is a giant hassle, or i have to go to court or something let me know, because i am really busy and honestly if need be i can just be really good for the next year (its 1 year for first point to drop am i correct?). Anyways thanks for the help! :thumbup

Your co-worker is not bullshitting you, you can only do traffic school every 18 months. Some counties offer an advanced traffic school, but those are rare. Were both tickets in the same county ?? If so, then you may be eligible depending on the counties rules.
If not, youre s.o.l. and the only way to keep it off your record would be to contest it and hope you get it dropped.

OK more info plz. The tickets were NOT in the same county, and my co-worker said I COULD do traffic school sooner than 18 months, so i am assuming you are stating that he is wrong. The most recent ticket is in Marin Co. so any county specific info would be helpful. and Psycho are you a LEO or otherwise associated with law?

No, but I've been through the gauntlet enough times to answer.
If you get a judge that likes you and sees that you dont have a history of speeding, he may allow for traffic school otherwise the only thing that will get the points off is for the violation to be dismissed.
And in order to be eligible for advanced traffic school, if I recall, both citations have to be in the same county. So I suggest that you get yourself a court date and ask the judge kindly for traffic school.

Traffic school:
If you wish to request traffic school you must register with the Court on or before the due date of your citation. You will be required to pay the FULL bail amount plus a $24.00 administrative fee and meet ALL of the following requirements:
1. You have a valid driver's license.
2. You are not holding a class A, class B, or commercial class C driver's license.
3. The current violation(s) did not occur while you were driving a commercial vehicle as defined in Vehicle Code 15210(b).
4. You have not attended traffic violator school for dismissal of a prior ticket issued within the past 18 months.
5. You are not currently charged with a misdemeanor.
6. Your citation is an infraction that is reportable to the DMV.
7. This citation does not have a point count of more than one point; involve alcohol or drugs; involve exceeding a speed limit by more than 25 miles per hour; or require a mandatory court appearance.

Judges do have some discretion regarding that. 4) is not a set in stone requirement, although most of the time, you do have to wait 18 months.

You could request the judge allow you to attend level 2 traffic school. It is longer (2 days?) and more expensive (like couple hundred bucks).
It is my understanding that if you take level 1 traffic school and it is within 18 months of your last one, DMV will just ignore it and put the point on your license anyhow... that means the court would be happy to charge you their fee and the traffic school will charge you their fee and let you waste your time.. to no avail. :cry
You did not follow the ticket help requirements, so there is some info missing from your post that would aid me in assisting you further. I'm not here to play 20 questions, so I guess you miss out. :p
