UNLOADED pistol in HOLSTER is ok on BIKE.

Covered pretty well in a discussion a long time ago, might want to try and search for it. But I am pretty sure you can't just leave it in plain view.
 
The transportation of a firearm, wether in a cage, big rig, bicycle or motorcycle is either in a locked box with a trigger lock or in the open with a trigger lock or slide lock or cable thru the barrel, etc., etc. Ammo in a seperate locked box. I would NOT want to be stopped by a cop with a gun in my holster, loaded or not, out in the open or not. This also includes rifles of any type! Sorry, can't give you the code #, but, just went thru another gun safety course and it was covered there. You are NOT even allowed to have your clips loaded, even if they are in a seperate locked box.
 
California Penal Code Section 12025 :

(a) A person is guilty of carrying a concealed firearm when he or she does any of the following:


(1) Carries concealed within any vehicle which is under his or her control or direction any pistol, revolver, or other firearm capable of being concealed upon the person.


(2) Carries concealed upon his or her person any pistol, revolver, or other firearm capable of being concealed upon the person.

....

(f) Firearms carried openly in belt holsters are not concealed within the meaning of this section.

So my interpretation is that it's "ok" but that's not definitive (obviously.)

Just make sure it's registered and defintiely don't do that in Frisco - you can't even own one here.

I wouldn't try to push the envelope on something like this, because your empty gun is as useful as a hammer.
 
Why would you want to carry an unloaded pistol in a holster?

You are just asking to have a LEO draw down on you with his/her loaded pistol and making you eat the pavement real fast.
 
In all fairness if you're going to the range on your bike (say you don't own a car) - you can throw it in your bag and risk a concealed charge or you can be riding round going "still dre day nigga, AK nigga!" on your waist-band.

Just playing devil's advocate here :)

But yeah i wouldn't be shocked if you got rolled up on by a cop with ali g going "get yo head in tha groun, and eat da dirt! "

or you can put it in a locked container anywhere on the bike and be fine. if I were transporting a handgun on a motorcycle, I would lock it to something under the seat (and as the seat requires a key to remove, I believe that simply loose and empty under the seat would be enough).
 
There may have been changes since long ago, but I seem to recall it was ok to carry a gun if it was not concealed (without locks, cables, etc).

Of course, walkin around brandishing a shotgun or a holstered pistol is gonna get the cops called and you'll be kissing concrete in short order no doubt.
 
I believe the handgun law in SF only applies to SF Citizens and I think implementation was delayed due to Constitutional issues and pending hearings. I have no doubt it will be thrown out, just like the assault weapons ban they (SF City Atty) fought for and lost a few years ago. What a waste of city resources.

As for the law, you can wear an unloaded and unconcealed pistol in CA if you are a non-felon, over 21 years old and not in a courthouse, airport or other restricted area. When carrying the gun, you may be lawfully detained and the weapon can be checked/inspected by a peace officer at any time.

This is one of those things like guys driving around with unloaded shotguns in the back window rack of their pick-up. It is something that is commonly seen in rural areas, but it totally freaks out soccer moms in their 4x4 SUVs that are never put into 4x4 mode, in the city.

My suggestion would be to get a locking case (a hard case or a soft zipper case) and secure the unloaded pistol in that case, then place it in a tank bag, backpack, trunk or saddlebag for transport to the range. Put the ammo in a separate container.

I wouldn't want to be in your shoes if you got pulled over or otherwise interacted with a cop and he saw a gun (unloaded or not) in your possession.

It won't be pleasant.

There is really no need for a beat down... I have never encountered someone with an exposed handgun, but I remember when paintball first started (1989'ish) and we routinely had citizens reporting subjects running with guns in the woods behind a local school. We had them put down their guns and prone out... no bloodletting, no use of force, simple and professional.

There is always the possibility the person with the gun is an off-duty officer or is a citizen with a valid CCW permit. We can't just go slammig people for carrying a gun on them, there are many that are permitted to carry a loaded gun.

I have never been stopped by police for simply carrying and I carry concealed all the time. It is just a matter of time before someone catches a glimpse of the butt of my pistol and calls 9-1-1. I'm not worried that it will get ugly as long as everyone remains calm and professional. I know I will.

If the gun isn't registered - licensed - in your name - it's a felony.

Specifically, any City, state or federal employee carrying out the functions of his or her government employment, including but not limited to peace officers as defined by California Penal Code Section 830 et. seq. "

There's a huge ass statement of it's consitutionality / etc in the code itself.

I remember taking a sun safety training course 10 years ago. Gun has to have some sort of lock, trigger lock, while the bullets have to be locked separately. Gun can't be loaded while in storage.

I understand what your saying. I am not saying that there would be a beat down per se, but it certainly raises the intensity level and brings alot of tension until the officer knows whats going on. All he knows is there is a gun. Ideally, it should be handled professionally and without issue. Hopefully, that would always be the case.
 
A few years back, on the way back from deer hunting i crossed the GG bridge with my .308 in the gun rack of my truck (clearly visible from the back window of my truck). I got a strange look from the toll taker but went on my merry way, with no SWAT ready to take me down.

When i was in high school in Texas (late 70's), we used to go hunt pheasant during lunch, it was not uncommon for most of the trucks in the parking lot to have shotguns in the gun racks. In fact it was the norm. Guess what, no one ever went on a shooting rampage, no one ever went postal or anything. That sort of thing would never fly these days.
 
just make sure your gun is all legal and you have no gang ties, 1st concealed weapon charge in this case is minor, if you have proven gang ties( shady friends) it can be a felony. Best way is to get your ccw. Remember, all cops like guns, they just dont like people running around with them
