car totaled, errant driver has no insurance

i posted yesterday about my wife getting rear-ended & my car getting totalled (found out yesterday $8K damage on a $4K car means totalled.)

Now I find out the asshat has no insurance. My wife's hurt, we are out of a car, no way for the wife to pick-up kids from school, & we are basically totally screwed. If I take time off work, I don't get paid (new job & all that- no vacation yet.)

The one lawyer I talked to (so far) says if he's got no insurance, the law office will not pursue it (something about can't get blood out of a turnip.) Apparently the errant cager has a suspended licence (due to accidents/DUI), & his insurance carrier has dropped him. (He lied about having insurance.)

Any suggestions? Anyone got a cheap 4-door they want to sell me? My family is so totally screwed; I may have to sell a bike just to get a car.....aaarrrggghhhh!!!!

What about your insurance? Hmm, $4k car means only liability?

I suggest looking at Craigslist for a car and I will keep my eyes out for one.

Also check with your local credit union and see about a short term loan. If you own your bikes outright or even if you don't and just owe a little you can put one or both up as collateral to buy a new car until your insurance can get things straightened out.

Example:

Don't know what year it is but let's say your (2001) ZX12 blue books at a low $5200. (http://www.nadaguides.com/) And let's say for whatever reason your CU will only lend to 80% of it's value. (Some places won't do 100% on bikes.) That's $4100 you can get cash for it. If you did a 3 year loan your monthly payments would be between $120 and $140 per month. When insurance settles use that money to pay off the bike loan.

If you walk in with your pink slip and pay stub in hand they can usually cut you a check within a few minutes if you're approved.

talk to another lawyer. if he owns a house, or ANYTHING there has to be a way to get something. even if he doesn't, can't the courts garner part of his wages (if he has a job)?
 
btw, i have no idea if this would help but i was reading about this "carshare" company online the other day. they only charge $4/hr of use + $.44/mile. i really don't know if it'd be at all convenient, but hey if it's an emergency http://www.citycarshare.org/crm/

If you have uninsured motorist coverage that will take care of your needs and get you a vehicle, get your policy out and take a look, report a claim with your insurance company and have them hire a lawyer on your behalf, thats what they are there for !!!

Sorry to hear about your wife's accident.

everyone else has said it already: look into your own insurance ... underinsured/uninsured part of it.

On that note, I have always talked about maximizing this coverage, especially for motorcycle riders. I have the maximum I can get, I guess, something like 100k/300k or something like that. A well worth coverge to maximize on.

a bit O/T, but what's the standard for deciding to total a car or not? My previous cage wasn't totaled and it cost $12K to repair, I think KBB is $13K.
 
how screwed is the car, can you post a picture up, even if the car looks really fucked up a lot of times you can turn it into an "ok" beater to be able to get around... me and my friend jason are always rebuilding my brothers car.. his whole front end had to be yanked out with a truck last time and his bumper is held on by screws and quickties.. :laughing

Its at the discretion of the adjuster and the auto body shop to determine whether the damages are repairable or not and whether its worth the cost to repair. Obviously if the damages exceed the value they are gonna total it, in which you have the opportunity to say hey I want to retain salvage and fix it myself.

Not trying to be a pessimist (guess that just comes naturally), but what are the odds of someone without auto insurance owning a house???

It's not up to you to decide what situation he's in. Or to negotiate a price.

If you cannot locate a 'cheap' car, pm me and I'll put you in touch with my neighbor who always buys cars at auction, then he fixes them up and sells them.

I bought my '85 Celica from him for $1,100 a few years ago and I've been driving it ever since.

I hope your wife gets better soon.
