School ordered American flag wearing students to turn 'em inside out

Supreme Court already answered this quesiton in 1969. Students in public schools (K-12)don't have an absolute right to free speech. See Tinker v. Des Moines School District.

Wasn't previously aware of this case study, interesting read. The part that sticks out was the Supreme Court opinion that that actions of the students must surpass a "mere discomfort or unpleasantness" in order for the action or speech to be declared unconstitutional.

As I interpreted the text, based upon the Supreme Court majority opinion in Tinker v. De Moines School District, the school violated the First Amendment rights of the students by requiring them to turn their shirts inside out.

This, of course, is taken at face value without the statements of parties involved.

What I really think it comes down to is if the school officials had cause to believe that the shirts would cause a situation beyond mere discomfort or unpleasantness in light of the previous of violence. Appellate courts aren't concerned with right or wrong, just the correct application of the law.
 
While the 9th might be legally correct, it still galls me no end… The Nazi swastika in Skokie, IL would instigate violence (completely understandable and acceptable violence, imo) against the National Socialist Party of America, but I cant accept the US flag would doe the same.

But I am more interested in the disgrace shown the American flag by the folks “wearing” them. Back in my childhood days we had these folks called hippies. They were all about pot smoking, free love, peace, and the kind of drivel only the wealthy or destitute can really embrace as a life style choice.

Anyway… Back then, the establishment viewed the American flag was a banner for the nation that was to be respected and treated with reverence. It was not to be used in the manufacturing process for shirts, pants, etc. But the hippies liked to use them for all kinds of garments as an anti-establishment statement. Those hippies are now grandparents… And their grandkids seem to have embraced this idea of American flag as garments as part of the pro-establishment movement. Is Rod Sterling living in Morgan Hill..? When did this practice become acceptable? Seriously, wtf…

And one awesome thing the Jay Walk segment exposed is that the average American doesn't know what the 4th of July is.

There's no law against being kind and sensitive to others. And that goes both ways.

Interesting, I've been to a dozen Bastille Day parties, lots of fun, great wine, cheese, bread, mille feuilles, etc. French flags all over, not a single American flag in sight. Everybody having a good time, kind of on a one-day getaway vacation from commute traffic, gun violence and Obamacare, you know, the great American values. Same for Brazilian carnival parties, (Irish) St. Patrick's Day parades, Chinese New Year celebration, etc. It goes to show the disposition towards Mexicans.

FYI, American schooling ranks low compared to other countries'. The dumb people you speak of aren't rare. Most American-born folks fail at the naturalization civic test; they can't name 2 tribes, not even Apache and Sioux. Just sayin'.

France isn't a significant source of illegal immigration. Mexico is. That one nation accounts for 58% of all illegal immigrants. And Latin America as a whole accounts for 80%.

Not to mention that many Mexicans are rather "in your face" about that whole "Aztlan Reconquista" and "we were here first" stuff.

Hell, even a company from Sweden (Absolut) has decided to up the ante and troll a bit. (After all, any publicity is good publicity. It's especially convenient for a Swedish company considering they have no stake in the controversy.....)

We could do the dance on why American schools score low vs other countries but we've done that dance before and people got upset with me because they cannot understand the differ ence between race and culture.

Your example of the Jay Walk all stars as representative of the average well of knowledge of Americans is dumb.
 
I fun it amusing that, as a kid, i wrote a series of short stories with a protagonist named Benito Juarez. Benito was a prohibition era gun runner, a crusader knight, an explorer and a post apocalyptic king. In reality he was a guy who chose not to pay his bills.
 
Interesting how racial tensions are growing between Latinos and whites.


In my hometown of petaluma, they used to have the "egg bowl", a football game between the two high schools.


They've since stopped holding this event bevause of huge racial issues. One school has a large Latino populace, the other mostly white. It's become such an issue it's crazy
