HOV ticket question, time related

I just now saw this post and decided to chime it because I have had this exact situation go to court.

I stop guy at 10 minutes to 7. His clock says 5 after 7 when I stop him, mine says 1853. He contested that my time was off. I inquired with dispatch what time she had, and she stated 1853. I cited him up. He went to court. I told the judge that in inquired with dispatch on the time, and that several minutes after I observed the violation it was 1853. It was not my fault the violator set his clock ahead.

But, if it was a moving violation, then wouldn't the OP be eligible for Traffic School, and thus not have it show up so Geico could see it?

That's up to the judge. I know for a fact that Hayward court will not allow traffic school if you're popped for speeding over 85. :|

Well, the ticketing cop told me that it was not traffic-school eligible (which is why I originally posted that I think I got bad advice) but it sounds like I was given bad info at some point: either the cop wrote it for the HOV violation and Geico screwed me, or the cop wrote it for moving violation and gave me bad advice.

Now I wish I still have the citation so I can see what CVC I actually got written up for, but that was in 2005 and so the 3 years have already passed and anyway I switched from Geico to State Farm thanks to the advices here on BARF and got a reduction in premium anyway, even during those 3 years.

I just want to post this up so others can learn from my experience, and the resultant discussion have been valuable for me too. Thanks guys :thumbup
 
Well HOV violation is about double the other...so do you remember about how much the fine was?
 
Well it was way back in 05 so I can't recall. I couldn't even hazard a guess if it was $100+ or $500+. If you threatened me with death I would probably guess it was closer to the $500 end of the range. This would mean it was the HOV violation huh?
 
I guess in theory your insurance company could raise your rates for a non-point violation, such as HOV violation, seat belt or cell phone.

Just because the violation does not carry a negligent op point, does not mean the insurance co. will give you a break.

So in that case you may want to use your traffic school to mask the violation from your record. OP - If I were you I would call your insurance company and ask based on ex911's experience. This might change the way you handle this.

I don't think there is any requirement for a manufacturer of a vehicle to provide an accurate clock (just like an accurate speedometer).

You do have a point and a right to know what the Officer's used as their time source, but why "jump" into the HOV lane at exactly 9:00 am? BTW- you have to wail until 9:01 AM.:nerd
The law states that a speedo will never register less that the vehicle is truely traveling. That is why vertually all speedos are optimistic out of the factory.

I can't possibly fathom how that makes sense in any way. What's the point of having speed limits if it's not a requirement to have something in a vehicle that tells you the speed of the vehicle? :wtf

Oh, but there is a requirement that you have something in the vehicle. That would be the driver. How they gain that knowledge is solely up to them.
