Records: Shooting suspect killed previous wife
The man accused of killing his wife and then shooting two church pastors had pleaded guilty and been sentenced to 10 years of probation in 1987 in the slaying of a previous wife, according to court records.
I don't know who thought that was a good idea, but whoever they were (collectively), they should be thrown in jail for criminal negligence.

Yes, we should hold DA's and judges accountable for not imposing longer sentences than the law allows. :rolleyes

Since when did murdering your wife only have a maximum sentence of 10 years probation?

If that was the case, there'd be quite a few dead spouses....it'd be much better than lawyer costs and alimony!

If you read the article you linked, the guy was convicted of manslaughter. Unless you know something about that case that nobody else does, he probably received the sentence that was available.

The entire body of the story changed since I posted it on here. There was no mention of it being manslaughter in the original story.

First, he plead down the charges. Then got a reduced sentence against those charges.

What were you saying about the DA and judge?

From article:
Prosecutors reduced the charge from first-degree murder... and they recommended probation instead of a prison sentence, according to court documents.

Why cut out relevant portions of the quote? Also from the article (which keeps changing by the hour, BTW):

Prosecutors reduced the charge from first-degree murder, saying that Fogle had handled the rifle in a "negligent, careless and reckless manner," and they recommended probation instead of a prison sentence, according to court documents.

Maybe they believed the shooting was accidental and negligent. Maybe they were fools. Maybe they didn't have enough to make a murder charge stick. Maybe this is clear 20/20 hindsight.

Cause all I was doing was pointing out that your claim was incorrect that is was the maximum sentence for the charge. Whether it was the right sentence, can't say, but it was neither the maximum charge, nor the maximum sentence within the reduced charge.

Wow.......I thought we had a perfect system that culled all evil from society.

Apparently, probation really set him straight!

it's a sad world where the PROSECUTORS try to talk down the charges.

WTF Probation? Most of us would get jail time just for SCARING someone with an AD.
