Hit massive pothole, filing a claim against caltrans?

This... or they will rip up 5 miles of perfectly fine road to repair that one pothole. I filled a claim once for a busted windshield and got a check.
 
I should have read this thread before I submitted my claim for the front wheel I destroyed on 680 on the way to the Hawthorne Rally. I put together 10 pages of good documentation, which took a little time and effort.

I should have set up something intimated in post #5. My claim was denied because Caltrans did not have "prior knowledge" of those holes.
 
There's a pot hole that size on altamont pass road but going twords tracy not oakland, if we are talking about the same pot hole, I've seen no less than 5 cars taken off the road by that thing. Drove past it the other day and I think it's been filled

Hey bud, sorry to hear about your luck. Hope it all works out for the better.

On a side note - and this is an intentional threadjack - where is this pothole? Please provide details of where the pothole is located for fellow riders and motorists (yes, it affects cagers too! A cager may see it late and swerve hitting another moto or car).

To the best of your ability, please provide as much info as possible i.e. Before/after which exit; what lane 1-4; middle, left or right of that specific lane etc.

The info is extremely important to your fellow riders; it'll keep everyone safe(r) out there.

My bad for not seeing the age of the original thread/post but AJ's post was recent; I felt compelled to inquire for all our sakes. Additionally, I'm headed up mines rd to the junction today via 580; my post was rather self-serving as well. :twofinger

I can assure you that Cal Trans does address pot holes. I had the 'opportunity' to 'volunteer' with Cal Trans for a few hundred hours and experienced first hand how the modern chain gang works.

For my chain gang to fill one pot hole with a pre mixed bag of asphalt it takes eight volunteers, a driver for them, a driver to provide the volunteers protection, and at least one CHP to divert traffic while the driver of the volunteers gets out and pours the premix in the hole, stomps on it, hits it with a shovel, and then takes an hour break.

That would be what we would do before lunch. Lunch was an hour or two nap at a nice park in the grass then back to fill another hole or maybe just wash the supervisors vehicles back at the yard.

Is that even legal itself?

If someone where to trip in front of your house they can darn sure file a lawsuit against you with no problem.
So why is a road any different?

No it's not just California, that's how Tort law works. Whether it's a store with a wet floor from spilled milk, a city street with pot holes or a homeowner with a cracked sidewalk, the injured party has to prove the defendant had prior knowledge of the defect and didn't act in a prudent manner to prevent the injury.
 
And you should be driving/riding at a speed that would enable you to see road hazards and be able to avoid them.

From the sound of it, chugging a few beers and driving through a DUI checkpoint may very well land you that job.

(though I doubt the lunch is free)

Unfortunately you have to bring your own lunch, unless you happen to find some cash on the side of the road as you're picking up garbage. Then the sup may take you all out to Burger King for lunch.

I'm sure that is one way to get the job. I got the opportunity by accepting an expired MMJ recommendation from an undercover. Oops!
 
I added a part of this thread to the General stickie about potholes. Review it here and let me know if I should add more or just add the whole darned thread.
 
I had run into a pothole in SF they gave me the same excuse of them needing to know about it before they can pay out but they broke down and paid me a few bucks less of the quote I gave them from the dealer.
