Actually they're taking the fork away from the fattest people at the all-you-can-eat buffet. The one they paid for.
As far as I know, they don't guarantee any speed in contract, just the upper bound.

True, but they have repeatedly branded it as "high speed." I'm no legal expert, but I'd bet a sandwich that a legal expert could make a case out of a company intentionally slowing the service down to where it is sub "high speed." That sort of murkiness is where star attorneys are made. They'll get tens of millions in legal fees in the settlement, and class members will get a $10 credit on their next bill (and probably a stealthy new, recurring $1.25 legal recovery fee added to the bill too).
