Yes brake checking is wrong. However, the tailgater is STILL more wrong because they aren't following safely. A brake check should never work because a vehicle should never be traveling so close for it to work.
What if there is a kid in the middle of the freeway? You would expect a car to slow quickly, yes?

Can you define tailgating, or is it just subjective? Is there a universally agreed definition? Or just one of those "I know it when I see it" things, in which case it's useless to even debate.

If you HAVE to brake or hit the car in front of you when you see brake lights, its tailgating.
Tailgating can be ignored. Not saying it's not bad or worse, but it can require no response.
Brake checking is just dumb, like starting a fight by punching yourself in the face in order to punch the other guy in the face.
