Cited for CVC 21706 what would you have done?

i was riding home from work on a Monday 7/28 the week before was pretty bad on 880 if i remember correctly? traffic started to slow down. i was in the car pool lane and noticed a good 1/2 to 3/4 mile down the freeway there was a CHP weaving from lanes 1 and 2 "car pool and the 'fast' lane". everyone was cruising 75mph and i assumed he was slowing down traffic for whatever reason. then i saw the solo vehicle accident on the center divider, some Prius look like it spun out and ended up facing against traffic and on top of the concrete barrier. The CHP was weaving to slow down the traffic because of the accident, now its obvious.

this is where my judgment screwed me. i saw the CHP weaving only in the 1 and 2 lanes. the vehicles in lanes 3 and 4 that where next to the officer took off ahead leaving 3 and 4 lanes cleared. the CHP continued to weave only in lanes 1 and 2 for a good 10 to 15 seconds even when lanes 3 and 4 where cleared. no one is passing this CHP.... it appeared the CHP knows where the dabre is on the freeway is and doesn't want to completely stop traffic. so being on my bike, i started to make my way over to lane 3 then to lane 4 splitting to the front of the line of cars, i can see the CHP to my left still weaving in lanes 1 and 2 now right in front of me and still no one is passing him...... i said to myself screw it. i accelerated a head perpendicular with the CHP, turned my head and looked at him, waved my hand and thumbs up as if my move is OK.. he looks at me and without any gestures gets on his radio. i say to myself, "god dammit hes gonna have his buddy ahead pull me over.." so i stay in lane 4 contiuned a head the lights light up and got a ticket for not following 300 feet behind a emergency vehicle.

well, i should of stayed behind the CHP but i got my ticket that i need to deal with. I'm curious if theres anything in between the lines that I'm missing or is questionable... this ticket is damn expensive.... any advice is appreciated

i was recommend to post the other CVC on the ticket, CVC16028A proof of insurance. i had an insurance card on my but it was expired and changed the policy number buy opening a new policy "i failed to print it out." the ticket shows the 3 different steps to clear the citation 1 pay the 900$, 2 pay 170$ for insurance with proof of correction and 3 appear at the traffic devisions...... i hope my ignorance to the ticketing doesn't skew the original posting. i assumed it had nothing to do with the original fine amount.

Humm... uhhhh... well.... that was dumb.

I avoid CHP like the plague, I would have quietly slinked back into the pack and went with the flow.

I can't even imagine your line of thinking to get you off, it was such a bad idea. I've had CHP give me tickets for things that weren't legit citations. :wtf I've learned to avoid those guys, seems to be a small man complex of sorts with them.

The missing element is whether or not the officer had his/her emergency lights activated. Were they?

yea i had a total laps of judgement.... lesson learned. and to answer the question about the light on... i can remember he was hard to see because i was so far back. the officer dident have his lights on... thanks for the web sight
 
How much is the fine?

I wrote one a while back and was sorely disappointed with how small the fine was.
 
The first time I saw a CHP do that here it kinda felt like the Twilight Zone. I thought someone had stolen the cruiser and had taken a bit too much of some whacked drug.

Hope the fine doesn't hurt you too much.
 
Were you two able to make any form of contact before you decided to go ahead? I would've honked or rode along his side until he acknowledged me then give the "Am I ok to pass?" look. If the Officer doesn't want to look, I would've backed off.
 
if a police officer is weaving back and forth between lanes it's never a good idea to pass them, do you think they are doing it just for fun? no they are blocking traffic or slowing it down for a reason and to just fly by the officer is a good reason for a ticket:rolleyes

so i did it for fun? well at least I'm not disappointed that my posting didn't get at least 1 negative response. thanks for telling the real reason why i did it.

I just looked at the bail between 21706 and 21706.5(b). There's a big difference in fees and penalties. Which one were you cited for?

Were you also driving in a double fine zone? Or get additionally cited? And how many previous convictions did you have in the previous 36 months before this ticket? All these things add up.

To answer your question, What would I have done?, I had the CHP do the weave break for me once when I was stuck with my bike in the median on I-80 one cold December night. :thumbup And before I was given such a weave break, I also witnessed a CHP cruiser weave in front of us while I was in my car. Everybody slowed the fuck down and then we waited to get the all clear before putting the pedal to the metal and speeding to our respective destinations. Whatever the emergency was up ahead us was long gone in the few minutes it took to travel those few miles. Anyway I try to keep Mark Twain's words in mind to help me with my judgment: When in doubt, don't.

how many laps of judgement did you make? sorry i cant help myself... anyway, yea dude. you shouldve just waited until he or another officer gave the all clear to go on by :mm4l. from what officers have told me, they often get annoyed with situations like this the same way they would for a parent driving dangerously with a child in the car. annoyed might be too light of a word here but you get the idea. good luck scraping that $$$ together. OUCH!
 
Maybe my brain is just wired differently but I NEVER would have considered just going ahead and passing.

Fear factor. Not fear of a ticket but fear of what I might run into that the CHP was trying to protect me from.

(I can think of a lot of things that might have been in my was to impede my progress: Debris, dead bodys, emergency vehicles, heck ...even rotor blades.)
 
I would have written it off to experience and hope I learned something.

Motorcycles (particularly sportbikes) are a huge public nuisance and just being on one is going to get you more attention than just about anyone else around (maybe the import tuner guys get more love but that's probably it). Doing anything questionable on one, especially if it makes you stand out from the pack of traffic around you, is a bad idea.

Is there a mandatory court appearance too or just pay the fine?

We only do traffic breaks with our emergency lights activated. Per law, all motorists are to say back 300 feet. If someone passes a patrol vehilce at that point in time, you bet they are going to get a ticket.

Ive never fought a ticket before. Ive always said, do the crime do the time.
I'm not the one to try to skate around the system. but man 900$?! I'm pretty positive that it wasn't a double fine zone. (between Fremont\Alvarado & Thorton). i had a speeding ticket that i cleared with school 3 months ago. when i decided to pass the CHP i was looking at him with a thumbs up, he just looks and grabs his hand held radio.. i said to myself, shit hes going to pulled me over for breaking through the line of cars, (whats now the worse I could do) . so i continued on at a slow pace and weighted. next exit i arrived at there his fellow CHP was behind me. i watched him gain on me with my rear view mirror. im going to take this to court
