Is it legal (CA or federal) to carry prescriptions outside of original container?

The solution has been posted- tell a reasonable story. If you aren't tweaking, have a reasonable explanation, maybe photocopy the Rx- most cops would go do something else. On the other hand- one could easily talk their way into a more serious hassle. You pick.

as a class A truck driver, and having to take something like 12 pills a day.
and some times i am forced to layover who knows where.
i do carry a daily dose in a small otc pill bottle.
and pending "other" i might have one or two (rarely) norcos on me.
yes all legal for me, most are for bp, bad joints/back, etc -not pain killers-.

no i do not even try to keep any paperwork in dealing with these pill,
mostly cause i do not want to know the side effects.

Instead of throwing away the paperwork that comes with the scripts, you could just file away one for each medication you have and keep them in your truck. That way, when you're out and about working, and don't have the bottles with you, and the issue somehow ever came up during a police contact, you could show them the paperwork. That will pretty much prove you are allowed to have the prescribed medication, assuming your paperwork has your name and prescription info on it, and assuming the officer has access to an on line or book pill indetifier. That could prevent an unnecessary arrest.

Having said that, my personal experience when this issue comes up is directly related to the person being in possession of illegal street drugs, and just so happens to have pain killer/muscle relaxant pills in their possession too, without proof of a prescription.

all of the pills i do carry are not going to get one high or impair anyone in anyway.

plus the container is a adult proof bottle. er i mean a kid proof. 😳

and tucked away deep in a overnight bag not on the dash.
so to even search the leo would have to invent a reason to search in the first place.
but three bp pills a couple aurtherites pills(not pain pills), etc not exactly on the druggie hit list.

I'll answer for him; as I mentioned earlier, a 100-pill bottle is like 5"x 2.5". It don't fit in your Levi's w/o being really uncomfortable....

EBDave - while it speaks well of you, you are giving the OP far too much credit. He didn't have a question, this was a quiz to see how 'well' the LEOs here did.

Not all baggage can be screened by the TSA...

uh...ok. I probably shouldn't have posted at all as it was directed to you folks. It's just a sore spot (pun intended) to me as I take pain meds for a number of surgeries I need to do including: knee/hip replacement, herniated disc(s)/spinal fusion, etc. etc. (list is long.)

I've carried in a plastic bag simply cuz it's more comfortable. It makes me mad I could be in trouble for that; I have valid prescriptions. The damn bottle is too BIG to carry in your pocket, period. What is one to do? I have been carrying a photocopy of the prescriptions in me pocket; I hope that would suffice for most Leos?

I also don't carry drive/ride on the heavy Type 2 stuff. I let the old-lady drive. On the bike it's too dang dangerous...slowed reactions & all that. It impedes me enough where I wouldn't want to ride on it. So, I wait until I get home; & just deal w/the pain until then...:thumbup Owe.
 
I got a kick out of reading Sawsall's rules of engagement. if you want to engage him in any way you must follow the rules...off the charts narcissism..
 
Just Carry paper RX stub in wallet

Every pharmacy I get RX from gives me wallet sized tear off copy with drug name and rx number ...I keep em for for tax purposes but since they would tit right in my wallet , I think I will start carrying if it is for pain meds etc ...because I take a lot of meds there is no way I am lugging all the original RX bottles on trips! I put them in daily dose compartments ...come to think of it THAT would be a slick trick for an illegal user! he/she could carry pill of choice camouflaged in seven or 14 day pill compartments varied bunch of supplements in each compartment ....HOW MANY cops are going to go through that inspecting each dose etc? Not reasonable ...then again maybe like the shaving creme cans with hidden compartments that is a well known ploy? ....I just have a criminal mind even if don't use it ever for anything but just bs talk

It's interesting; I'm still flabbergasted I can be arrested simply because I'm carrying pain pills in a plastic bag. The medical providers do NOT provide any other way to carry them! That prescription bottle doesn't fit in me Levi's.:mad

I take 28 pills a day for countless issues; I guess the "pill-holder" would be the only way to go? My medical provider (Kaiser) doesn't provide a "sheet/ detachable card" for each medicine. You just get a paper(s) describing the med, & a pill bottle w/the med inside. All info is printed on outside of the bottle...

Guess I'll just have to carry the description sheet, or a scanned copy of the bottle outside? I know me dosage & my doc's name/info; not like I'm going to make all that stuff up...?

Any legal issues with possession with a prescription, if it's expired? Pain meds, prescribed to me, for a condition that's still present but rarely requires enough to warrant Percocet. The expiration date on the bottle is coming up, I don't need more, they still work fine, but I don't want to get arrested for it.

Wow, old thread. But interesting.

AFAIK, Percocet is generic for Oxy. Nowadays providers are freaking over control of these drugs. Crazy tight with them and all sorts of new rules for docs to prescribe pain killers.

I do not know if expiration would be a problem, doubt it unless you had a bottle of 1000 pills, where LEO might figure you were selling them. :wow
Once the script is in your name, I'm pretty sure you are good to go ... Worth looking into.

If you often travel with pain killers or other drugs I'd get your pharmacy to print out labels of your scrips for you to carry rather than entire bottle.

Like others, I use the multi-day dividers, but I rarely have any pain meds.
Blood pressure, heart, Gout, 81mg Aspirin. Millions of travelers use these divider thingies. In hundreds of airport searches, never been asked,
many countries outside USA as well.

Not entirely. "Percocet" is Acetaminophen (Tylenol) and OxyCodone and comes in varying strengths (2.5mg/325mg, 5/325, 7.5/325, 10/325). Percocet has other names such as Endocet, Roxicet, and Tylox.

OxyCodone is also available without the Acetaminophen and has varying forms such as immediate release, extended release (OxyContin), tamper resistant, etc...
