Goddam you. For the last month, I have had the Prince song Kiss stuck in my head. Only not the whole song, just the little guitar breakdown followed by the part where he says "Kiss". Only in my head it's Mike Tyson saying Kith. So it keeps going dwiddle dwiddle dwee......Kith.

I don't believe DOT checks this. I think that a manufacturer claims that the headlights meet FMVSS 108, and they're good to go.

Ever ridden on or around a CSC RX3 at night? Low beam looks like a parking light. High beam however performs about like a low beam, so it's alright. Sort of.

Basing that on a sample size of 1, but owner claims his isn't defective, rather that the lights suck, and it's a common topic on the forums.
Manufacturers do self certify that an item meets FVMSS 108 but they're also liable for a recall and remedy if the NHSTA tests the item and it is not compliant. 49 CFR 564 also covers certain lighting components.
