My first 'accident' caused by a righteous cager

I once had a motorcyclist try to take the mirror off of my civic. Being a motorcyclist, I can guarantee you I wasn't trying to prevent him from splitting. To this day I don't know what he thinks I did.

But I can tell you it was several minutes before I calmed down. I can't tell you exactly what I would have done had I caught him.

My advice is don't intentionally do damage to another vehicle unless you need to alert them that they're about to force you into a collision or off the road. Then kick their door and let them know you're there.

If that guy could get a motorcyclist in a civic to want to hurt him, what would a redneck in a truck end up doing? Makes me think of the truck last summer that followed a harley rider in san jose i think and ran him over, killing him.

I am surprised you have gone 12 years and 200,000 miles accident free if you ride they way you talk.
for your info a cop just because he is off duty doesnot mean he cannot arrest you if he witnesses a crime,
a cop is a cop 24/7 when a crime is committed.
second if you go before a judge who is he likely believe , a chp officer or a motorcycleist who just knocked off his mirror lane splitting and said it was his right to lane share.
if an attorney gave you that advise ,I would not have him defend you in a court trial.
second never underestimate your opponent, say they guy in the s10 is 5 foot 4 145 lbs and your 6-6 250 and your going to kick his skull in , you walk up to the truck he pulls a .357 and your dead, shit happens.
please undertand I agree with you some people just hate to see
us lamne split while they are stuckj in traffic , but its not worth
all the bad that can happen when you escalate a situation .
I totally agree with nsr250sp and his post , the gross tonage law does and will apply, motorcyclist will usually lose.For me is not worth the risk, just cuss the guy out under your breath change lanes and go on , life is to short

I never kicked in a quarter panel! Possible Pete, but not me. However, I did remember an time out on 25 where some dick tried to take Pete and I out for some reason... He was slightly surprised to come around a corner a little down the road, and see Pete and I standing on the side of the road. He was even more surprised when he was showered with rocks. But that ride wasn't with the Vampires...


Speaking of. If it's available Charles, how do you feel about the
NSR being one of the featured bikes for the premeir of Faster
at the Rio on Wednesday the 26th of May? I figured we'd cram
a few race/race replicas in the lobby for the press to oggle.

Well i live in the Valley (Stockton) and fortunetely the traffic here is not that bad at all, usally the only time I to lane split is when I head to the bay. :shhh
 
I was given a roadside lecture from a motor officer, the point of which was...

"sharing a lane is only possible when the traffic is moving, when it is stopped, you are PASSING ON THE RIGHT, which is illegal."

He let me off, but I am less likely to go between stopped traffic at a stoplight than before.

I can't believe that there are not any motor officers who belong to this forum, and would be willing to share thier perspectives on this.

Having replace a mirror at my own expense after being passed in stopped traffic I can understand why some folks are somewhat less than friendly to passing bikes, but attempting to hit another motorist with your vehicle is a Felony.

Bottom line, it is thier fender and my leg, who is gonna win?

That is a good question, I would be interested from a chp about it,
from what I was told as long as you are in the lane you can pass whether the cager is stopped or moving, you cannot ride the white line, you have to be in the lane. The kicker is its up to the officer who seeing you do this if your are doing it safely, its his judgement call, if he feels you are unsafe he can ticket you, and that one is almost always a lose if you try to fight it as its your word against his,

but will a chp officer pls put his .02 on it

I had to comment on what you have shared here....

Being that the law is supposedly objective.....and if Robert gets pulled over...
About the only thing that may happen is the case may be pleaded down to simple vandalism.....(hard thing to prove intent unless there are priors)

Robert can argue that as he approached, the driver of the car indeed willfully
closed the lane off, presenting a possibly deadly situation and it could be deemed ADW. The plaintiff would have a hard time arguing that Robert did it on purpose.

Since lane sharing is legal in CA, Robert will usually have a lawful right to be where he is, unless a wintessing CHP or Police officer deems otherwise.

If people close the lanes (which I have seen quite often..) I usually open the lane up for the motoryclist.

I had the pleasure of seeing this done to a LEO at about sundown....(where you can't really tell who the motorcyclist pulling up on you is)....and a yuppie in an SUV closed the lane.....

the lights came on and I am sure this yuppie had to go home and change his pants, All surrounding vehicles made it a point to honk and laugh at him. :teeth

I hope I never see RObert do it......I'd laugh so hard, I'd crash...:laughing
