Red light Ticket! any experince?

a friend was driving my car in downtown san francisco. he crossed the intersection on yellow and still the flashing cameras took some nice pictures of him..

and today i received a red light violation ticket.

what should i do?

do i have to tell the court who it is?

if i dont then the ticket will stay on my car or on my record?

what should i do :/

what i wanted to knw was, do i have to identify the driver driving the car?

fwiw your friend is probably lying and crossed on red... they leave a gap of time between red and camera photo...

What does your friend have to say? He should step up and take responsibility so you don't loos time off from work to appear.

I read it as you being required to admit your friend's guilt. You saying that the driver wasn't you isn't the same as saying who the driver was, as it requests. I'd say you were screwing your friend over, but he ran the light, so it's his fault anyway.
 
If you have recieved a summons to appear, YOU BETTER APPEAR. A failure to appear is more trouble than its worth (possible suspended license).

"Your Honor, I don't recall who that person is" is a possible answer. BUT, if your friend is a friend, he will do the right thing. If he doesn't, how much of a friend is he?
 
ill go to court whenever the date is. the friend who was driving has been going through a hard time for a while, he cannot afford a ticket right now :/
i wish i could help him financially but as i cant, il just have to lie and say i dont knw him.

No one handed you a ticket and said "sign here," right?

Throw it in the trash. Dare anyone to prove you even received it. After you delete this thread, of course. :laughing

No, not really. A summons to appear must actually be served to you, it can't just be mailed since it can't be proven that you received the summons. Proof of service must be shown before a judge can revoke your driving privilege or issue a bench warrant. You can throw mailed citations in the garbage.

So what to do about this ticket? Ignore it. Don't respond, don't do anything.

If you respond to the ticket, you've waived your right to service and you'll have to deal with it.

If you have to deal with it, just tell the judge it wasn't you. You will not have to reveal the name of your friend, there is no law requiring it and the judge won't even ask.

You are not legally required to implicate your friend. You cannot be compelled to testify.

If you choose to protect your friend, you will have to go to court, and fight the ticket on the grounds that it is clearly not you in the photograph.

The last CITY BIKE that I saw, there was a new lawyer advertiseing that deals with tickets (VS criminal). Check it out and give him a call.

Have you seen the pic of the driver (alledged)? Is it CLEARLY not you?

Flat out DO NOT ignore it. that shit will bite you in the ass later. First of all if your friend is gonna run red lights then he should have the money to pay for the tickets. Its SF and they dont mess around with that stuff there. Wether is catches up to you on your record or with the dmv it WILL catch up. they are all interlinked now. And DO NOT miss the court date if you go that route. A failure to Appear is serious and will cost you way more then that ticket would ever cost. Ive gotten one on a fix it ticket before. I would contact the court and say you were not driving the car that day and "one" of your roommates must have taken your car without permission that day. say you have several and honestly dont know which one it is. or something like that. Bottom line dont take the heat for someone elses actions. Its not worth it. everyone needs to be responsible for themselves.

Do not ignore it.

I suggest making a copy of what you received in the mail, tell Friend you received the ticket, ask / tell them to take care of it within one week; verify it's been taken care of and get notification of that in writing from the issuing agency / court at least a week before the court date. If you don't have it at the court date, show up, prove that it wasn't you. At this point you may or may not have to identify Friend. Don't perjure yourself.

Friend got busted and needs to deal. You'll have to do exercises in CYA until you know it's done.

Another option is to just pay the fine and consider it as taking a hit for him.

Do you have to identify Friend? No, but you'll pay for it if they don't take care of it.

Will it go on your record? It'll follow your vehicle at least; could be worse than that too.
