Red temporary operating permit tag

Are officers allow to pull you over simply because your the car got temp. tag? I didnt speed, make illegal u-turn, or violate any traffic laws. I was not under the influence of any substances. Is this stop legal?
 
If it is clearly displayed to the rear, and valid, then it is not a reason to stop in an of itself.

I have seen many obstructed by window tint, for example. If the officer did not or could not see the temporary permit, then the stop would be good.
 
yes it was display clearly on the rear window on the top corner (no tint), and it was 10 in the morning on a sunny day. I was pull over for "expire registration" when i clearly have the permit visible along with license plate on my trunk. I was driving with suspended license which cause more problem. I appreciated the officer kindness for not towing my car and let my friend pick it up. But is this stop valid?

Once again i didnt not violate any traffic violation or invovled in any criminal activity because the officer approach my car and didnt state his reason for pulling me over. He ask for license and registration. Before i hand him the paperwork i straight up told him about my license suspension. I got a ticket for VC4000 and VC 14600.1 (registration expire and suspended license). It obviously that my registration isnt a expire so that will get dimiss but how about the suspended license?
 
If the officer didn't see your temp tag in the window the stop is valid. If you can show that a reasonable person should have been able to see the temp tag then the stop would be a bad one.

In reality you shouldn't be driving if your license is suspended. Your vehicle SHOULD have been towed and impounded. There is anothe thread in this forum right now discussing the costs associated with getting your vehicle impounded.

My advice is to complete the registration process and get your vehicle registration current. Get your drivers license situation fixed and get valid. Then go to court and show them everything is current and your citations should be dismissed.
 
And by the way, you were committing a crime. You were driving when your privelege to do so was suspended which is a misdemeanor punishable by time in county jail.
 
Question about that, currently on my wife's car we have a red tag in the back but the window is tinted pretty dark. It's kinda hard to see, especially in the sun from even close up.

Is that something she can get in trouble for? I'm not worried about her being stopped so much, but more would she get a fine for it? I don't really know of any other solution to display the tag in a more favorable way.
 
I've always taped the crap out of them with clear packing tape (until they were waterproof) and attached them to the outside of my car window.

No missing that tag.
 
what is the number on your red tag? is it still valid? is it the correct red tag? even better, go take a picture of your car from the rear (you can block your license plate number if you want) and let us see what we're looking at.
 
I believe there is brand new case law regarding this scenario. I'll see what I can find, but hopefully someone can beat me to it cause it could be awhile.

the last one i heard said we couldn't stop solely to inspect the tag like we used to...
 
my tags was valid until the 6/30 and it clearly printed on the tags itself. I was pull over on the 6/17. When i sign the ticket i was too happy the officer didnt tow my car and i didnt look over the ticket until i get home.

OP is lucky the car didn't get towed. He/she cut you some serious slack there. I'm sure your honesty helped.

in Alameda traffic court the suspended will typically get dropped if the violator gets their license valid prior to court.

Being "creative" is what gets cops in trouble and erodes the trust of the community in the police. 200+ years of court decisions and corresponding case law have dictated the rules we must follow. We are given a lot of discretion in what we do. Straying outside the lines will eventually lead to limitations on that discretion. If I can't find a legit reason to stop someone they aren't getting stopped.
 
On the first court date, are you allow to present any evidences to the judge? Or it simply guilt, not guilty, or no contest and wait for the trial?
 
It should be a reason to be stopped, simply to let the cop confirm it's legit. Those things are so non-official looking anyone with a printer or copy machine can fabricate one...
