Fast track violation

I did a search and only came up with one thread but it didnt answer my question.

Story: yesterday i was on my way to my cousins house in american canyon, i thought i had my fast track transponder in the center console like i normally do. When i passed the fast track lane on the carquinez bridge i realized the screen didnt flash looked in the console sure enough it wasnt there damn!

Then highway patrol pulled me over, i told the officer i have a fast track transponder but i guess i must have left it at home. Otherwise id leave it in my center console.

To ad more fuel to the fire my plate had got stolen a few days ago and i had ordered new plates from the DMV, so i had put the dealer plate back on and the little temporary sticker in the back window (which you couldnt see through the tinted window in the back)

He gives me the ticket codes read:

23302 - Paytoll violation
5200VC - No license plate

Both marked Uncorrectable WTF?!

Cant i show proof that i have a fast track and the dmv temp reg sticker to show why i didnt have plates????

I cant believe this would go on my record, they could at least just charge me the $25 they normally charge if you dont have any cash on you or if you run through the fast track without a transponder and they just flash your plates.

But to say its uncorrectable when i have reasons and proof for both the violations is ridiculous!!!

and 5200VC is probably dismissable when you submit the paperwork to the court showing your plates were stolen.

with all the news about recent mass toll violators they've been pretty strict on having your transponder on you.
 
How can he give you a toll vio if your bike is Reg as having fast track??

It was actually my car but thats what im saying!!!!, i think he just assumed that since i had a dealer plate on he thought i did it intentionally. And when i told him that this car is registered on my fastrak account he probably didnt want to let me go without giving me some kinda ticket i guess.


So does that mean i cant get a point on my record? I mean either way i have proof that i have a fastrak account with the car on it. Only thing worrying me is having a point on my record.
 
Just bring all your evidence/paperwork to court and you'll get your ticket dismissed.

I'm surprised chp will tag people for toll violations. As long as your vehicle is registered to your fastrak account, then the camera is supposed to snap it and automatically deduct the toll from your account.

I have all my vehicles registered to a single fasttrak account and never carry my transponder.

Yes you can get a ticket for it even if you have a fastrak account and your contract says you must have the transponder in the vehicle. It was all covered in this thread.

You had the license plate(s) for the vehicle stolen
You put a dealer plate and red DMV reg sticker in the window

How is this legitimate? I don't understand why you didn't get written for 4462b.

I had a plate stolen from my personal vehicle. There was no "ordering" of plates or anything like that. CHP took a phone report. I walked into DMV, surrendered the 1 plate I still had, walked out with 2 new plates. Paid $17.

Are you blowing smoke, or is there something different they do now?

"dealer plate" meaning the advertisement for the dealership I'm guessing, not a dealer specific license plate.
 
go online and print out ur fastrack proof...and show it to them...
 
u have the plate number and all that stuff registered on ur fastrack so no matter what if u had plates or not it would still be valid...show ur registration and the plate number on the fastrack info...then ur clear...
 
The fact that its "not correctable" doesn't make it a moving violation. Driving in the carpool lane is "not correctable" but its not a moving violation. The fact that you have a fast track device, but just didn't have it on you is irrelevant. All cars have seat belts, but you still get a cite for not wearing one. It might have been an accident, but that is also irrelevant, because this is an "infraction" of the law meaning that your intent to break the law or not break the law doesn't matter. 5200 VC is a correctable violation normally, but it can be made not correctable under certain circumstance. So people could look at your car not having a fast track device and not having plates as a way to intentionally evade paying a toll. In your case, even though it could totally be a legitimate misunderstanding, and officer could reasonably deduct that you were intentionally trying to evade the toll, and cite it as not correctable.

No, they still do it that way. That hasn't changed at all. Even if they're personalized plates they will give you a set of new, temporary plates to put on your car til the personalized ones come in. Thats what happened to me like 3 years ago and I havent heard of anything new goin on and I deal with DMV regarding registrations everyday. :dunno

The fact of the matter is that he didnt have his transponder and you are to have it at all times and thats what he was cited for. Stolen plates or not, he had didnt have his fast trak and they dinged him.

"Refusal to Pay Tolls
23302. (a) It is unlawful for any person to refuse to pay tolls or other charges on any vehicular crossing or toll highway. It is prima facie evidence of a violation of this section for any person to enter upon any vehicular crossing without either lawful money of the United States in the person's immediate possession in an amount sufficient to pay the prescribed tolls or other charges due from that person or transponder or other electronic toll payment device associated with a valid Automatic Vehicle Identification account with a balance sufficient to pay those tolls.

(b) For vehicular crossings and toll highways that uses electronic toll collection as the only method of paying tolls or other charges, it is prima facie evidence of a violation of this section for any person to enter the vehicular crossing or toll highway without a transponder or other electronic toll payment device associated with a valid Automatic Vehicle Identification account with a balance sufficient to pay those tolls. If a transponder or other electronic toll payment device is used to pay tolls or other charges due, the device shall be located in, or on the vehicle in a location so as to be visible for the purpose of enforcement at all times when the vehicle is located on the vehicular crossing or toll highway. Where required by the operator of a vehicular crossing or toll highway, this requirement applies even if the operator offers free travel or nontoll accounts to certain classes of users."

The car only came with one plate to begin with so i had no plate to surrender. The DMV said they will send out new ones and they gave me a temp reg sticker until i got it in the mail. I just paid the registration renewal that was coming up and $26 for the new plates that i didnt receive in person.

No reason for me to blow smoke at you, again i have all the paperwork the whole point of me making this thread was because i was worried about getting a point on my record.
 
whoa when did they change things to require you to have your transponder in your vehicle? the fastrak site used to say explicitly that you didn't need to carry it in your vehicle. does this mean i need to get a second transponder for my bike?

If you did the transaction in person, they should have handed you new plates when you handed them the form stating that your plates were stolen. I've had to replace plates twice this year - once on a trailer (the plate fell off somewhere between San Jose and San Diego) and once on my truck (changed from personalized plates to standard plates). For the trailer I filled out the requisite form stating that the plate was lost, handed it to the DMV clerk along with a few dollars and she handed me a new plate. Similarly I filled out the form for my truck plates, stating that I was going to keep the personalized plates, handed the form to the clerk who promptly handed me back a set of standard plates along with the month and year stickers.

Of course if you do it through the mail, then it'll take longer...
