It seems odd (for both parties) that the price wasn't agreed on when he placed the order.
I'm not hating - I totally get the supply and demand thing. When I bought a WRX back in 2001, you could drive them off the forecourt for $8k over invoice, or order and wait 8 weeks for invoice price. I did the latter, but to each his own.
My thoughts also. How does one place an order for a specific configuration without a contract and a firm price?
Sorry Rob, but $50K over sticker for a guy who's had a deposit down for 10 years sounds shady. Again, did they not agree on the price prior?

Just so you know that we will be asking a $50k premium over whatever MSRP your specification winds up at as this is a very limited release vehicle and you will have the very first one around here. Are you ready to move forward.
Him-Yes. Sounds good.

Us- Hi Mr. xxxx. Thank you for placing an order. We're just about set to "lock it in" and send it to the factory. Are there any changes you'd like to make? As it sits right now, your specification is blah blah blah with a MSRP of xxx, destination of xxx, and a $50k market adjustment. Everything still sounds good?
Him-Yup! Can't wait for it to come in!

Us-I'm sorry we can't accomadate that and if you had any issues with the price, that really should have been brought up before you ordered it to your unique specification. The total price for your vehicle is xxx, and if that's not agreeable....then you....

We know what he tried to pull. Figured that once he got the order locked in to his specific build he could leverage us into dropping the price if he threatened to back out. We called his bluff.
Yeah his deposit was down for a decade. But was never to lock in a price. Because we didn't know what it was going to cost or if was even going to even be made at all.. All it bought him was first rights of refusal when and if they ever made another NSX which he excercised. We just wish he didn't spec it out beforehand.
Berto knows this but maybe some of you other guys don't. In CA, a deposit is pretty worthless to the dealer. You can order a car, put down a deposit to do so, and just refuse it and get your money back at anytime before you sign a purchase agreement.
