RIP Rebecca

RIP Rebecca.

The problem with tweakers is they drive when they are drunk and then stay awake on meth. Double trouble and still impaired.

This dude is death penalty material.

Its amazing how the sportsbike community is generally very anti-drinking while driving. Whereas the cruiser HD community invokes a culture that includes having a few before or while riding as acceptable. I'm I off base here?

I won't say "all" the cruiser HD community condones riding and drinking, but I will say that the few HD guys I know plan bar stops into their rides.

I don't ride with them anymore.

Your not off base. I went on 1 "poker run" a few years ago. That was my first & last one. There used to be a bike night at schooners in Antioch. Mainly an H.D. crowd. I'd see some of that group have 3-4 beers then getting on their rides and taking off. While stats have shown that the older cruiser crowd to have higher rate of alcohol related wrecks I seriously doubt the entire H.D./ cruiser crowd condones any drinking while riding/driving. I haven't touched a drop since 91.

The hardest part about DUI collision, either misdo or felony, is the human impact.

Rebecca's egg photo and her myspace page really drive that home. After seeing her picture, it just makes me want to get out there and hammer DUI drivers all that more. Makes for great motivation......

People just don't consider the impact of driving drunk. It seems so harmless in the beginning, then all of a sudden things go so very wrong.

Don't forget the victims of drunk driving, and don't let drunk drivers off the hook. Get on your local reps, start getting the word out that we're not going to take it any more.

If we can get laws passed to prevent people from smoking in our favorite places to eat, then maybe we can get laws passed to keep people from driving drunk.

San Jose man sentenced to 35 years to life for 2005 fatal crash

A 49-year-old San Jose man was sentenced today in San Mateo County Superior Court to 35 years to life in state prison in connection with a 2005 crash south of Half Moon Bay that killed a University of California, Santa Cruz
student.

Mark Henderson was convicted of second-degree murder in November for crashing his pickup truck head-on into a motorcycle driven by 19-year-old Rebecca Seibenmorgen along Highway 1 on Oct. 1, 2005.

Judge Joseph Scott denied defense attorney John Halley's motion to strike a previous conviction Henderson had for a 1983 felony assault with a deadly weapon.

By counting the 2005 crash as Henderson's second strike the term was doubled from 15 to 30 years to life. An additional five-year consecutive sentence was added on for multiple felonies that cause bodily harm to others, according to Deputy District Attorney Sean Gallagher.

Scott said that he does not believe Henderson has the ability to control his actions.

"I am thoroughly convinced that if you are released and automobiles are the main use for transportation you will drive under the influence again, and create the same danger to the public that you have been creating," Scott said.

Henderson was arrested after briefly leaving the scene of the accident to dispose of methamphetamine and cocaine he had with him, according to the district attorney's office. Authorities found a small amount of cocaine in his possession, prosecutors said.

During the trial, Henderson, a self-described methamphetamine addict, denied he was under the influence of narcotics before the crash, claiming he had merely been extremely tired and sleepy. Witnesses who were driving behind Henderson's truck before the crash testified that he appeared to be weaving along the road and driving under the influence, Gallagher said.

Seibenmorgen's mother Regine spoke briefly at the sentencing, telling Henderson through her tears that he "disregards the welfare of everyone around (him.)"

"You killed our daughter," Seibenmorgen said. "You knew damn well what the consequences would be (for driving under the influence) and you did it anyway!"

According to Gallagher, Henderson has three previous DUI convictions, in 1986, 1988 and 1990, and as part of his sentence, attended several treatment programs and classes designed to educate about the dangers of drugs, and thus should have known full well the potential consequences.

Thanks for the update Rel.

Good to see that the turd got his just due.

Finally, punishment to fit the crime for a motorist killing a rider (or at least much closer than anything that I've heard or).

Well I sure hope he doesn’t get rear-ended in prison. :p

wow so sad. and knowing that she is from the town that i am currently going to school at; Saint Mary's College in Moraga. No wonder there was a big mourning at a local church. So sad... continue riding in heaven :ride :rip

She's from just down the road for me as well. I feel horrible for her parents. That crash took at least three lives.

If I lost my daughter I'd fucking die too.

thanks for update Rel

i'm glad the judge denied defense's motion

Thanks for the update.
