Ticketed for not yielding to a ped (sting op)

I just have this image in my head...

you come to a stop sign, slow down and stop. There's a cop standing at the entrance to the crosswalk, foot extended, not moving. The look on his face says 'go ahead, pull into the crosswalk. My foot will hit the ground before you get in, so you'll be breaking the law'.

that would be one hell of a sting op.

If anyone thinks that me fighting this is somehow a statement that ped safety isn't important, you're missing my point. First, this wasn't a ped... it was a cop. It was a fabricated situation.

I work in the Union Square area, and for all those LEO's who preach ped safety... why don't you try hanging around down here for a change? There is a steady flow of ped's j-walking across from the garage to Macy's, LV, Gucci... alll, I'm sure, all are on a really, really important shopping mission. I have never seen any ped ticketed for this. Ever. Double standard at the very least.

YIELD not STOP. that is my interpretation. its like yielding to other traffic. if you dont fuck with their speed/line then go.

Ummm, it's not really a quote without attribution.

If you want to know which BARF LEO lost his father to some asshole murdering driver who could not stop at a crosswalk, then search the LEO forum. It won't take long to find the answer.

Since he's not been much on BARF lately since March 21, I can only imagine that he is still in mourning for his friend. BARF is such a trivial thing when a friend is murdered, ya know.

I spend a ton of time as a ped in SF; I don't have any difficulty finding lights to cross at, and on the rare occasions I feel "forced" to cross at a non-regulated light, I rely on the training I received from my parents and schools: I FREAKIN' YIELD TO CARS, EVEN IF I LEGALLY HAVE THE RIGHT-OF-WAY.

Duh.

There's about a million BARF threads about NOT duking it out with cars just because you have the right-of-way, simply because if you tangle the moto loses... Double standard much? Is SFPD going to help us out by stinging those who violate our right-of-way? Not very likely...

The whole ped-sting thing is mainly public relations, with a bit of extra revenue for the mix (and to anyone who says tickets don't raise revenue- give me a break and prove it!).

It's certainly not about safety, because if SF genuinely cared about ped safety they'd look into perhaps ticketing the HUGE number of peds who don't heed any traffic laws or safety basics.

For those that are not "so lazy and/or stupid folks can be more thoroughly coddled, politicians and police" could very easily do a search for that threads where the fees, percentages, and where fine money goes to for citation, do the easy math, and figure this out. :twofinger
So now prove you theory.:|

So a cop walking is not a pedestrian? What law is that?

I knew someone would ask.....

Why are we even bothering with this thread? The OP clearly doesnt like the answers he's been given.

Go to court, and see what happens.

Please report back the outcome.

Both brilliant and insightful. Thanks for your feedback.:|

Guess you didn't read the thread. Please explain why you would assume there were no peds because you couldn't see around the car.

I agree with some, I don't agree with others. Are successful threads those that the OP agrees with all? (Don't think I have ever seen one of those...)

I thank everyone for their feedback, even those I didn't agree with. I will take it to court and let you know the outcome.

Stopped for a couple peds in a crosswalk this morning and thought about this thread, I'm heading south, four lanes, two in each direction. Two peds cross in front of me, I'm next to the center line, range rover coming the other way doesn't even slow down as passes by them with about two feet to spare.

Was driving in Berkeley today, three different times pedestrians walk out into traffic without bothering to look, causing cars that are about to enter the intersection to slam on their brakes.

Out of curiosity, what does the law say about the responsibility of the pedestrian in these cases? In other places I have lived the pedestrian can't just walk out into flowing traffic, they have to wait for a break or for someone to stop.

A: Its illegal for the peds to do it.

B: If they get hit, its their own damn fault.

C: About 9 months ago, there was a pedestrian accident like that in Berkeley, and word came down from on high. The next week had cops standing on the corners in downtown Berkeley writing jaywalking tickets.

Hmmm, searching BARF just turns up a whole bunch of folks saying "look it up," but no actual facts and/or numbers...

So, I went straight to the horse's mouth and talked to a local watch commander about it. He gave me a funny (pitying, almost) look and asked "do you seriously think we'd write tickets if we lost money on them?"

I explained the root of my query, and he hypothesized that either those posters are minimizing the revenue aspect or that they don't know what they're talking about. In his case it seems that ticket-writing drives are politically driven, either to "address a problem" (irony his) or to add $$$ to municipal coffers; in any case the impetus for those drives/stings propagates from politicians, not from LEOs or other safety-oriented personnel (they have moe than enough fish to fry without catering to special interests).

Search= http://www.bayarearidersforum.com/forums/showthread.php?t=239240&highlight=fines

Look at the percentages that actually go back to the agency. And then see that those funds go to the city general fund, not the police department. So the police never see the money (And no money from fines go back to the CHP, they are funded through DMV registration fees).

Then add up the small percentage that goes back to the city, add up my yearly salary, vehicle cost and equipment, and you will see that we would be lucky just to break even. If your local watch commander said different, he is an idiot.

PS- I’m still waiting for you evidence to support your theory.

Ooh, you found ONE thread! On the internet! Would you call that "evidence?"

In that case, here's mine:

Let's see, what was it I said...oh yeah, politically motivated, not safety related! So some percentage does go back to the city, which would make that city's politician's motivations...FINANCIAL MOTIVATIONS!

(I never said that the cops were financially motivated, only that they take their orders from City Halls, and therefore not from folks who are actually interested in actually affecting safety and/or crime. It's all shuck and jive, man, shuck and jive. If they really cared about ped safety there's FAR better ways to ensure that- starting with looking at ped habits first.)

Hmmm, you think he's an idiot? Perhaps he'd think the same of ingenuous/credulous you... And I know he'd rather be addressing real issues and crimes as opposed to writing sting-operation-based tickets that you seem to support.

As for think traffic enforcement is stupid, I again challenge you to look at how many people are killed in homicides and how many are collided in traffic collisions in a city each year. People say the resources should go to where people are getting killed. In the majority of cities you will see a lot more are killed in collision that as a result of homicide.

So again, we are going on your assumptions, theories, and lack of any numbers, statistics, or evidence that money is made by traffic citations, I.E. revenue generation. I have backed up my claims with the facts and numbers; I'm still waiting for you to do the same.:rolleyes

Dear NVP:

I’m sorry that you feel that the ticket you got was unfair; however, please just take the time to read my post.

About a year ago my godson (5 years old) was crossing a marked crosswalk in SF when he was hit by an inattentive driver. When my cousin and 3 kids were crossing the marked crosswalk the 1st driver stopped, but when the 2nd driver “saw” my cousin when it was too late. My cousin reached out to all 3 children to stop them (they were on her right side) and was only able to stop two of them.

Had my cousin not paid attention and stopped two out of the three kids I’m sure all of them would have end up in the hospital if not 6ft under. Unfortunately, my godson was hit and flew about 20ft from where the vehicle stopped. He never lost consciousness and thank God he still was at the “flexible bone” stage so his body was able to absorb most of the energy from the impact. He had to spend one night under observation because the doctors discovered a skull hairline fracture. He has not developed any symptoms that would alarm the doctors or us; however, he will be going thru regular check ups for at least 5 more years. As I’m sure you realized that the psychological trauma not only that affected my godson, but also his siblings (imagine seeing your little brother hit by a car.)

Given, you were paying attention and you were riding a motorcycle; however, I do not believe you were riding safely for traffic conditions and here is why:
-You were riding at speed LIMIT; therefore, you were going too fast. I believe this because traffic was slowing down which means they SAW something that made them brake! You should have slow down and prepare to stop.
-You scanned, had a blind spot and by the time you saw the pedestrian you were out of safe choices.

I know that I’ve been guilty of the same (thinking that speed limit was safe) hell I almost ran over a guy on a wheelchair crossing a marked crosswalk as I was approaching an intersection… I remember thinking “Why is everyone slowing down?” Luckily I was able to avoid him by making an unsafe right (in my defense he was rolling really fast thru the intersection! :p) I literally had to stop snap out of it apologize to the guy and then crawl home.

Now let me be clear, had I been under the SAME circumstances I would have made the same decision you made; however, I like to avoid putting myself under those circumstances by slow down at intersections and braking if I have a blind spot!

Yes getting a ticket sucks, but I think you are coming out of this experience, pretty cheap (if you learned something from it.) Imagine, if it would have been a vehicle running thru the intersection, perhaps an animal, or maybe a child; what would have been the outcome then? My point is that you would not have been able to see ANY of these until it would have been too late, for you, them or both.

Speed safely my friend and keep your rubber side down!
